If there is no payment involved can they legally give it away then?
Though if person X does become ill from the said item. Can they still sue etc. Is the store still liable?
I believe the law says store cannot sell stuff beyond "use by" . I have always taken this to mean that they cannot take money for it ( but Im not a lawyer and I may be wrong )0 -
He obviously doesnt know the implications - as selling items past "use by" is illegal and opens the store up to possible prosecution. ( which is why one of the posters above was given the strawberries for free )
I've observed the store manager concerned and I think he knew exactly what he was doing and the implications. I suspect he took a risk knowing Trading Standards' approach to enforcement and prosecution: http://www.tradingstandardsblog.com/out-of-date-food-trading-standards/Free thinker.:cool:0
