I think that stands a better chance.
The danger with overdrafts is that the 'cause of action' is not as clear as with loans or credit card. Say you walked away from a bank account with zero balance but not having closed it (can you prove you closed it?). If there was a £10 monthly fee and a £200 overdraft limit then you will still be operating within the terms and conditions of the account for maybe 20 months (a bit less with interest). They could come back with some sort of argument like this but I think it's a defence that the courts will take more notice of, at least in the first instance.
You could still use your other points but if you do, make the statute barred points high up the list so they get read. However, I think Lowell and the courts would deal with the other points quite swiftly.0 -
