Help with sofa

Hi, I got my first ever loan 8 weeks ago when I ordered my 3 piece suite on 0% finance from Sofaworks. It was meant to be delivered on Friday but the van drivers were 'took hostage' then eventually the 2nd van that took the sofas from them 'broke down'. Today, it is meant to be delivered again within a certain time slot but it hasn't turned up! The finance agreement says I only have 14 days to cancel so I am too late. Do I have any other options to cancel as I don't want it now. Failed to deliver twice and I'm getting messed around with stupid story's. Would rather cancel and go elsewhere. Is it possible? I feel powerless. Thanks

Phone the loan provider and see what the options are.

Section 59/61 comes immediately into mind......

Sure, it's a finance package directly linked to the product.

See Martin's Section 75 guide here.

Not 59/61, sorry. I'm on holiday at the moment, so my brain isn't in the correct mode.

There may be minor differences, but as they're linked, should be covered.

    From the link above:
Similarly, if you're claiming for a sofa bought with instalment credit, your claim's with the finance company (the company you repay to) not DFS or SCS (though you're free to complain to them too).

Thanks very much. So I'm giving the finance company a ring after the school run. I will quote this section 75 due to non delivery of goods and see if I can get a refund? Thanks

    S75 is the best bet.
Just cancelling the finance will mean you still owe the money to Sofaworks, but you would have the financing any more. You need to find a way to cancel the contract all together (which s75 will do)

Not sure a section 75 claim is going to work this early if the original delivery was only scheduled for Friday (4th July) and it sounds more like the OP has changed their mind and wants to cancel.

If after several weeks there was no sofa then you may be able to make a S75 claim with the finance company but now I would be very surprised if you got anywhere.
