Me and my ex partner are going bankrupt soon and she is adament she is going to try and keep the house that she and our daughter live in. The house is in negative equity so have been told their is a good chance however I am curious how my bankruptcy will affect it as the bank would not remove my name from the morgage previously. In case anyone is wondering I am paying nothing towards this morgage as I no longer live their, this was my exs.
I had initially posted this in wrong thread so am reposting, mainly want to know how this will impact the chance of my daughter keeping her home as that main priorty. Will house stay in my name as well.

    If the property is in negative equity, then there is nothing to be gained from the OR selling it.

    Both your ORs will look at both your shares of any equity in any property.

    There appears to be none.

    Both ORs will possibly look again after 2 years 3 months.

    If by then, the house has acquired some positive equity, then both OR's will want your respective shares...either by someone directly purchasing the ORs interest in the property..or, if the equity is significant, by compelling a sale.
    Note, there are limits, below which both OR's might seek to place Charges on the property instead?

    I am presuming the mortgage payments have been kept up [by your Ex?]?
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......
