Me and my ex partner are going bankrupt soon and she is adament she is going to try and keep the house that she and our daughter live in. The house is in negative equity so have been told their is a good chance however I am curious how my bankruptcy will affect it as the bank would not remove my name from the morgage previously. In case anyone is wondering I am paying nothing towards this morgage as I no longer live their, this was my exs choice not mine.

There is a separate board for bankruptcy questions so it may be better to post there if you have more: http://forums.moneysavingexpert.com/forumdisplay.php?f=136
Your going bankrupt will extinguish your liability for the mortgage. The mortgage will remain in existance and the lender can repossess the house if mortgage payments are not made, but you cannot be chased for mortgage payments or for any shortfall if it is repossessed and sold.
Your ex needs seperate advice about her situation as it is more complex.
I trust you are making the appropriate child maintenece payments.0 -
Yes I am and to be ckear my wife ended the marrage because she wanted to see other people. I know legaly I am responsible for half the morgage but she insisted she handle it on her own . I will post this in other forum as am still unsure over wheither my name will remain on the morgage or not.
thanks.0
