Hi Guys,

First of all I would like to thank you guys for everything I have seen you do on these forums!

Next, I am new to all of this... I have never had these issues before and I have no idea what to do, I have spent literally all day looking through forums and google just for some advice.

A few years back I had a really good job, I was bringing in enough money to pay my bills, my rent etc... I was happy.

Then, due to unforeseen circumstances (my manager, who was also my car share left) I could not get to work, I could not get transferred, therefore, I had no job...

I contacted the people I was paying EVERY MONTH about this and asked if they could 'freeze' my accounts for a short period while I found something else. Most declined. I had just lost my job, and then I lost my home (I could not pay the rent and they refused to wait for housing benefit to be sorted, this is now sorted and paid off).

The few creditors that allowed me to freeze my accounts have been paid off and/or have payment plans in place. However, the ones that did not, just did not get paid.

Being that the job market is what it is at present, I decided that being that I am now homeless and have no job, it would probably be a good time to go back to university and prepare for the future... I moved around, a lot, living literally anywhere that would let me stay, friends, family, strangers if I must... I slept on sofas, floors, spare rooms etc... as you can imagine, my post did not keep up.

Incidentally, I am now a student who works on and off doing temp jobs that come up around the times I am not at uni (summer holidays etc.) but I have no full time, permanent job.

So... this brings me to where I am now...

I am currently back with my mum and have been for about 6 months (I am going in to my forth year at uni as third year included a break for mental health reasons, so it’s been a while since all this kicked off!) my post has just caught up with me and I had a letter from Bryan Carter telling me that I have not being replying and nothing has been arranged, therefore they are applying to court, a few days later the court forms drop through my door. I have 14 days to reply (this was Friday)...

Now, I understand that I owe this money; it was to O2 for a phone that when I lost my job I asked them to cancel, they refused and when I did not pay they cut it off and continued to charge for. I am not saying I will not pay the money, BUT I am a student that has four weeks left in my current job, how do I pay it all by then and still live?

Also, I anticipate this is the start of a fair few that will be coming through the door now I have stayed in one place and they must all be around the same mark of, "you are going to court laddy"

Any advice please or is it a case of I am screwed and I will be bankrupt by the end of my degree and a degree in business and management is wasted as no one employ's someone as a manager when they have been bankrupt? :/

    Hi,
    If you are not going to defend the claim, my advise would be to agree an affordable repayment plan with them, however, if you will be out of work shortly, advise the court of this, they cant make you pay what you don't have, the judge may award them £1 a month if you have little or no income.


    But its important to make them aware of your current situation.

    I do not see the point in defending the claim if I have to pay it, my only argument is why they did not cancel it in the first place when they knew the situation. Bit harsh I feel... :(

    Agreed, but as you were in a contract, they are, unfortunately entitled to charge you for the duration of it, they don't take your personal circumstances into account Im afraid :(
