CCA Request next step?

Hi Everyone, I sent 2 x cca requests to the DCA's involved by recorded delivery on 10th June but i have not heard anything from them can you please advise what my next step is please?? Before i sent these in both had offered 50% settlements but i am wanting a bit lower if poss! many thanks Stu

    Just wait. Then, when they next write, respond with a complaint asking where the CCA you requested is. If they need to get them from the original creditor it usually takes longer then 14 days.

    Are these pre April 2007 accounts?

    thanks for your reply happy bunny yes both are pre-2007 one was for amex moved to NCO Europe and the other was EGG which is now with Marlin collections, NCO have not replied at all but keep offering 50% discount in writing and with Marlin they say the agreement is with Britannica SARL which they have written to and again i have a 50% offer in place. I will give them a few more weeks and then put another "low" offer in to see what they say many thanks

    OP, if you don't get a response in the next couple of weeks, you need to chase up the CCA request, do not respond to there "50% off offers", the very fact you are receiving these is because they probably know they may have issues with the paperwork.


    Just submitting a CCA request automatically puts your account on hold, and if they don't respond or cant find it, they cant obtain a CCJ against you as long as the CCA request remains unfulfilled, so its important you follow the correct procedure here in order to obtain the best results.

    thanks for the reply sourcrates, I sent both cca requests on 10th June by 1st class recorded delivery so they are outside the window to reply tbh, i have stepped away from payplan and my monthly payment is £31 & £10 respectively which i will continue to do directly unless i am advised not to pay them anymore money until this is sorted?? Just checked my papaerwork i have 6 x 50% offers from marlin and 3 x 50% offers from NCO and i have not responded to any of them...thanks again!

    Until your CCA request has been complied with, you are not obligated to make any payments to these accounts, this could also been the reason they are dragging there feet to be honest.

    Also do you think it prudent to call them to inform them of my actions ref non-payment to cover myself off with this?

    I was just quoting the law regarding CCA requests, if your happy doing what your doing, then keep doing it.
    Don't ever ring a DCA, do everything in writing.
    I would assume the default has already been registered against these accounts anyway, so your credit cant be hurt any further.


    If you Google "CCA request" there is lots of info out there.

    Have you checked your credit file? If you have been with Payplan the accounts certainly won't be up to date. Best thing would be that they have been defaulted at the beginning of your plan. Worst case is that they have been marking them with late markers all the way through.

    i will order another copy of my file from equifax as i have checked experian and both are not there the same with noddle, i will have to assume both are defaulted until i get the data back, thanks to all for your time and support appreciated
