statute barred 13 year old CCJ

    Hi all quick update, TBi been pestering me for a few days then called on a private number i answered and she asked for card details to which i replied the debt is statute barred i am not paying.

    She replied well you have been so that is irrelevant,
    i replied i shall be putting it in writing, at this point her tone changed and she accepted that and said ok (end of call).

    Why oh Why continue to ring day and night when they though know the score!!

    Because until they realise you are wise to it, they think they can con you.

    After i refused to pay on the basis that the debt was statute barred i received a nice letter with a photocopied CCJ from 2001.
    Ok I thought and intrigued i was that i spoke to them the next day they rang and was told if i didnt pay that they would inforce the notice. i did ask why in 13 years it had not been inforced to which i didnt get a straight answer. Any ideas on next course of action:j
  • Dear numbnut debt collector, As you are aware the court take the position that 6 years is more than sufficient time to enforce a CCJ. Duer v Frazer [2001] 1 All ER 249 and Patel v Singh [2002] EWCA Civ 1938. Any enforcement action you may consider will be opposed.

  • WOW really that i didnt know, was starting to panic a bit that i might have started chirping off to them a bit to early and might have had to back down and swallow some humble pie. Alarms were going off slightly as its not as if i have been living on mars for 13 years and thay didnt know where to come to inforce the CCJ.

    Also would a company that can inforce a 13 year old CCJ really need to continually ring 3 times a day, everyday, week after week?????????

  • Contact the court on the CCJ and ask them to verify the document, it could be a fake.
    I do Contracts, all day every day.

    I did have to change my mobile number though due to the bombardment.

    Hi all just got a letter from spratt endicott acting on behalf of TBI financial saying i got to pay £1300 in 7 days or they will enforce the court order against me dated from 2001. Any advice from anyone would be great
