Part time work - bank holiday query

Hi. Firstly, apologies for reposting if this has been covered before - I'm struggling to understand some of the responses.

I am employed on a 9 month, part time contract and am trying to work out if I should get a pro rata allowance for BH's that fall on my days off.

Contract info: 30/04/14 - 30/01/15
24 hrs per week: Always Mon - Thurs (6 hrs per day) but I am working some Fridays as overtime to help with workloads.
Hol allowance for full time is: 23 days plus 8 bank hols.
I have been given 13.5 days plus bank hols I work to cover until the end of my contract.

No contract as yet (it's being sorted) but my offer letter states "The offer is based on provision of services for a minimum of 24 hours per week, including a paid holiday allowance of a full day each statutory bank holiday and 13.5 other additional days."

My question is, should I get an allowance for any BH's falling on a Friday, i.e. Boxing Day this year? They say no but I don't understand their answer (sorry, only verbal but something along the lines of being part time/pro rata etc - I can go back to them & clarify if required).

The HR dept are open to info on this as they have only just started to employ part time staff (I'm the second to query this). They are also open to putting my AL into hours rather than days but I'm not sure of the benefit of this so would welcome opinions.

If anyone can advise, that would be great. Many thanks.

In my experience, if Friday is not one of your normal working days then you won't get it as a bank holiday, I suppose it is a grey area and all depends on how your contract is worded, but if you only work occasional Fridays then you won't get that day off as a bank holiday. Others will probably give you better information, mine is just based on personal experience.

You are entitled to all holidays including bank holidays on a pro-rata basis.

for example if you work for 4/5 of the hours and there are 10 days of bank holidays then you are entitled to 8 days. This means if one falls on a day you normally work then you have to use some of your holiday entitlement but if you aren't normally working then it is free for other useage

You will get on holiday 13.5 days plus any bank holiday that lands on a Monday (I make this three from the end of April until your contract end) which means you get 16.5 days holiday.

A part timer cannot be treated differently to a full time with regards holiday so really if a full timer gets 23+ bank holidays (8 days) then you should get 3/5ths of this which is 18.6 days holiday which is normally rounded up to 19 but it doesn't have to be. Overall I make it that for the year you would be 2.1 days down, however as you work 9 months of 12 you will actually be better of than a full timer (pro rata) by over 4 days worth of holiday.

If your HR are open to advice then tell them to change their terminology from 23 days plus BH's to 31 days total with Bank holidays being taken from this allowance.

    .

    working wed 30/04/14 to friday 30/01/15 39 weeks + 1 day(thurs)

    full time is 31 days,
working part time 0.8 so 24.8
working 39 of 52 so 18.6 + a bit for the extra day

you will work/take 5 bh so they are giving you 18.5 so a bit short.

if they want to go to hours 31days is 6.2 weeks holiday acrual is 6.2/(52-6.2) = 13.54% of hours worked.

The op works 4 days a week and there are two BH on thursdays.
