Estimate revised child support payment

Hi,
I'm hoping that someone can help, after putting with my exs bs for the last 2.5 years I had enough and called the csa.
I wld say the nice lady at the csa but that wld be a lie, told me that my ex was earning 25% more now then there records showed for 2 years ago and therefore he was going to have to send in pay slips for them to evaluate.
She wldnt tell me how much he was earning now, helpful when trying to budget but did say based on the salary 2 years ago he should have been paying me £262.
Is anyone able to do an estimate of what I might now recieve, based on 25% salary increase, it's for 2 children and less than 52 nights a year.
Also I thought under the new scheme victims of domestic violence had the right to chose payment through the csa or whatever it's new nàmr is?? It's one of the reasons I went through them as he uses the money as control. However she said he had the right to chose not me!!
I saw I had the only pro nrp worker in the csa as everything he'd told her was gospel and I was the bad person!!!

Based on what you have typed £262=0.2 net therefore net =£1310, now a 25% increase in net =£1637
so the new amount maybe £1637*0.2 =£328 rounded up to the next £1.
To a point he does have a right to choose not you.
If he is paying you direct then you can opt to have it via the csa.0 -
Thanks for working that out for me, it's about £1,600 he's cheated his children out of!!
The csa woman said that he cld choose and they wld just review it every year now there was a case, due to the new fees!!
It seems it'll be another 14 years till I can actually escape him!!0 -
What you have been told about him getting to choose to pay you directly is correct, as you have applied to CMS; the CSA no longer accepts applications. This is because charging is about to start for 2012 cases.
People who have reported domestic violence to one of a prescribed list of individuals or organisations are exempt from paying the £20 application fee (charged for any application made after 30 June). Everything else is the same rules applied across the board, including you having to pay the 4% collection charge should CMS refuse a paying parents request to pay directly.
Also DUTR's calculation is slightly incorrect, as 20% net for 2 children is 2003 scheme. 2012 scheme is 16% of gross taxable less pension contributions, if gross pay is between £200 and £800 a week. See below.
From the way you phrase it, you didn't tell them your ex was earning 25% more then the historic info they obtained from HMRC, which can only mean he did.
Does he have any children in his household (whether naturally his or not) or does he have any other children he pays maintenance for? That would impact the calculation.
If no, then it will be the same amount as DUTR says, but the calculation to get to the end is wrong, due to not accounting for it being a 2012 case. This will make a difference if the answer to any of the above questions is yes. So:
(£262/16)x100 = £1637.50x12= £19,650x1.25 =£24,562.5x16% = £3930/12= £327.5.
Or done more simply, which is why the end calculation is still the same whether 2003 or 2012 scheme: £262 x 125% = £327.50.
It's also worth noting that if his income is 24.99% different than the historic info obtained from HMRC, then CMS will not take account of the change, and your maintenance will be the £262. It must be at least 25% different for them to change the amount mid year, rather than at your annual review; a bit like tax credits will only change an award mid year if your income goes down by at least £2500.I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. He is able to choose whether to pay you directly or to opt for CMS collection as he faces collection fees of 20%, which is a considerable amount. If direct pay is set as the service type and he then misses a payment then you can contact CMS and ask them to collect on your behalf. You'll have to pay 4% of the maintenance collected for this service.
I'm slightly confused though, did you have a csa case previously or did you always have a private arrangement?0
