hello all! what a great and helpful site this is it is well run and really helpful
Me and my wife have a problem we have decided to put the house up for
sale and move away abroad. we do have debts which we are finding it hard to pay them all. we do alot of overtime not seeing each other nor the kids and pay off the bills then do all the same the next month all over again we are both off sick at the moment with stress. so has soon as we get our wages sorted as to what will be coming in we are going to get a dmp from cccs we have spoken to them.
We have a mortage off £125.000 fixed term we spoke to the company they said fine you can sell as long as they get the money no pops. there will be £23.000 approx left but our concern is that we have a secured loan against the house we have not defauled on it at all so we are up to date can they take that money off us after the house has sold that means the loan will then be unsecured. we know that we really should pay of as many bills as poss but the parents has said they will give us some money to run a bar in spain we are not running away and not paying the bills we are sorting them out then putting money into the bank every month to pay them. hopefully some one can tell us if they will take the money off us thanks xx

The CCCS are offering advice on the thread below, they should be able to advise.

The mortgage and secured loan must be paid before any money from the sale of the house will be released to you ... is that what you are asking?
To give any other advice would need full details of your income, spending and full debt details so if you would like to post an SOA I'm sure people here will be able to help.

thank you very much for your replys. when the house is sold the mortgage company gets there money straight away i have spoken to them to ask if we can sell they said yes. but what happens to the secured loan we have not defaulted and carrying on with the monthly payments so how can they take money of you if your still paying them have they got the right to take a lump sum of you when the house is sold? okay here we go !!!!
mortgage stands at £124.900 fixed rate 2 years we pay £588.00 monthly
secured loan £60.000 approx. we pay £590.00 monthly 25 years
then we have poll tax £102.00
bank loan £86.49
life insu £53.97 joint
bt £50.00
car ins £38.42
water £25.83
home. bulid. £25.26
car ins £24.10
sky £21.00
gas /elctric £80.00
conservatory £149.00
boiler £64.03
also there is credit cards total about £35.000 which are about £90.00 to £120.00 a month for each. about 12 cards in total.
on top of that there is bus fare for the kids and petrol for the cars in which we need to get to work as our works is not near us and not on a bus route.
with the overtime i have been bringing in about £1800.00 and the wife started a new job 2 months ago and wages not sorted out yet so first month was £668.00 then £863 should be £970.00 month but as she been off with stress and dont get sick pay who knows if even get paid this month and where it was a 3 month trial they propley wont have her back. with not doing overtime i would bring in about £1200. and they have taken more staff on so overtime will be no longer. we can do a dmp with cccs when we get my wage slip in august cause that will show no over time and sickness and show the wage i will be getting in future thanks to you all x0
