Misconduct/misuse of NHS email - complaint stonewalled.

    Regardless of the rights and wrongs of the actions carried out by Person A, it does smack of a vendetta by you.

    The issue has been brought to the attention of the CEO and I can only imagine that she has something on the CEO if no action has been taken, for nothing more than bringing the trust into disrepute. Sounds more likely you're being told that any action taken is none of your business.

    I`m with Starry (and others on this).

    The person who *should* have made the complaint was the member of the family who has been affected by this and not you , as your not affected.

    If any disciplinary measures are being taken, your not entitled to know the results as you havent been affected AND its a confidential matter between the Employer & Employee.

    We took all of that, and the only single thing that I have done in response thus far has been to make a single complaint against Person A's use of her taxpayer funded computer equipment to organise her political activity.

    The response that I got was nonsensical in the extreme so I asked for clarification, at which point I have been met with contemptible silence.

    How, exactly, a) do you come to the conclusion that it is ME who is perpetrating some sort of vendetta and b) that it is "none of my business"?

    Because you made the compliant & it was responded to. You, presumably didn't / don't agree with the response and therefore are pushing for a response that you do agree with.......I take it that even if they did come back with a further explanation you wouldn't be happy.

    As has been said what happens to her is not your concern but a matter between her and her employer, should they feel she has a case to answer

    Thank you for your letter of x confirming that Miss A's emails of y stating (insert defamatory content here) was authorised by the trust.

    There is no truth to the allegations whatsoever. I require the trust to take the following actions to put the situation right .... Failing which please provide an address for service of proceedings


    Should concentrate his mind on the issues a bit more.

    Some of these replies have been less than helpful and very discourteous to the OP..I read your post earlier today so do remember what is was regarding.


    Sometimes it does'nt pay to go straight to the very top, you could contact her line manager, departmental manager or HR department. This is serious misuse of the NHS email system as each employee is entrusted to use it responsibiliy as each email is headed with the NHS logo and therefore each email can be deemed to be linked to the NHS (of sorts).
    We were warned when we were signed up for it that any misuse that could be construed to implicate the NHS could resort in disaplinary action or dismissal. I do know that my manager would of strung us up by the ankles and thrashed us with razor wire just before handing us our P45.
    I would contact her manager and detail all proof, make them aware of any distress caused to your family and ask for an investigation. Remember though the NHS is not at fault just the person abusing their email system. Another thing to remember is that they will not be able to discuss what action is taken(if any) but hopefully this mode of communication for the person in question can be shut down.
