My very first post on here so go easy on me!!
Got a car on finance about 6/7 yrs ago
For just under £28,000
Paid £21,000 off it n fell into difficulties and couldn't pay monthly repayments and the last £7000 (there abouts) off...
...the car was worth just under double what we owed...
Are you sure? You bought a car worth under £28,000, and believe that after six or so years it was still worth £14,000
What was the car?0 -
Thanks for your responses
So I think I need to ring the court and say I'm disputing the amount
It was a pretty much brand new Merc sports i didn't have the car 6 years it's taken them around that long to do what they've done now
I've always been at same address so I've no idea why I've had nothing until now
Yep I understand cars will sell for less at auction. We delivered the car back to them so there shouldn't be no fees for that!!! That's why we did it that way!!0 -
Shall I contact debt collectors and ask for all info on fees and what car sold for etc
How can they not knock anything off for selling car?? Because the original balance before they added all interest on was what we owed after sending car straight back so nothing knocked off for car sale??? They can't do that can they ?0 -
Ah... so its a debt collector? Which one?0

It's a debt collectors but it's says a name of a solicitors too??? Why do debt collectors have no powers so to speak? I've had this thing to pay from the courts?? I'm so confused and not sleep over it all
I just can't believe this has happened when ive heard nothing for YEARS!!!0 -
Hi all
I've spoke to courts today (horrid lady who answered phone) she says if I send the attachments of earnings back that's me admitting the full amount or I can FN244 form and try to set aside ccj if I disagree with it
But I can't do that until I find out exactly what the car sold for so I've had to ring the solicitors that are mentioned on the attachment form
Guy was ok on phone and said he would email me the full break down if everything ( he wasn't dealing with it so wasn't sure) he said if I agree we can go ahead and make some sort of payment offer if I didn't agree I need to call then back up! He said email will take no more than two days to come thro!!
Prob I've got now is I'm on a time limit from the court as they've only given me 8 days to return this attachment order!!!
What shall I do? Solicitor said he couldn't advise me on what to do at the moment but he said they won't push for any future action at the moment
Arrrrr I'm getting somewhere but worried about the court
Should I write to court and say I'm waiting for some information and possibly going to look doing the FN244 form??0 -
I don't know how/if you can get an extension to the latest form you have been sent from the court.
I would again suggest that national debtline might be able to help give you some advise on how to reply to the item you have received from the court.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I've rang the national debt line today & the guy said I need to speak to the financial ombudsman !!!! Basically said he couldn't help then the ombudsman said they couldn't help as I haven't got a direct complaint I want to make !! Totally fed up !! I'm winging atm by myself !! Lady at court pretty much said I need to hurry up and get form into them which means I accept the amount or I need to pay £155 to dispute it?? For one I can't afford that and I can't dispute til I hear back from finance solicitors ??0

They only had the car for 3 years, its 4 years since they handed it back. Entirely feasible that a £28k car would have a residual value of £12-15k after 3 years. Its amazing how these banks can't even do simple calculations correctly..............0
