I don't want two cameras

Can anyone advise which way I should approach my problem.

I purchased a camera from my local independent camera shop in March and paid on my Nat West credit card.

My son took this camera backpacking to Australia at the end of March, it was a camera which could be used underwater as he was planning to use it when diving on the Great Barrier Reef. On his first dive the camera failed and filled with water despite carrying out the relative instructions.

I rang the shop and asked them to log my complaint in their diary and explained I would not be able to return the camera until he came home from his travels.

In the meantime he had to purchase a camera in Australia to use while traveling.

I am now concerned the local shop will want to send the camera away and have it repaired under the guarantee , but I would really like my money back because after all we don't need two expensive cameras that both do the same job.

What are my rights and what do other forum members suggest I do?

    Depending how long you had the camera for, the retailer can choose to repair, replace or refund, depending which is the cheapest option for the retailer. You could insist on a refund but you aren't legally entitled to it. If you are stuck with 2 cameras, why not sell it on sites like eBay or gumtree.

    You have a "reasonable time" to inspect the goods to ensure they conform to contract.

    A reasonable time is not defined but it can take into account circumstances - such as buying winter sporting gear in summer, reasonable time may be extended up until winter. Or a lawnmower in winter, reasonable time may be extended to summer.

    In this case I think you could successfully argue you were still within a reasonable time to reject outright for a full refund.
