Appealed after final reminder from PPC but not offered appeal

Hi

I am a little confused. I sent the standard appeal letter from this site to the ppc (UKPC) upon the final reminder letter. However they did not send me any letter regarding the appeal process or popla but instead still went straight to the debt recovery plus letter. Have they not followed the rules considering i sent an appeal letter before my time was up? I sent it by post with proof of posting so they cant deny it.

Does anyone know what i should do now. Should i respond again to the PPC or respond to debt recovery people? The fine was for leaving the site. The car park is free when on site so they have lost nothing so don't really know what the can claim from me anyway.

any help would be much appreciated. Sorry i was worried to post this as i see it says don't post new threads but cant find anything regarding the PPC not offering me the appeal they should..

    no fine was issued , just a speculative invoice

    if you appealed within the correct timescales , they should have issued a cancellation or a popla code , so if you were within the timescales complain to the BPA with copies of your paperwork

    ignore debt recovery as they cannot do anything

    I hope you read the NEWBIES sticky thread as it tells you all about this , especially debt collectors so I fail to see how you can say there are no threads covering this

    Depends if they received your appeal within 28 days of the first letter, the Notice to Keeper.

    Thankyou for your replies. Sorry RedX i have looked at the neewbie thread and have seen all about debt collectors but nothing specifically about not receiving an appeal letter after sending an appeal to the PPC. Sorry i may have missed this.

    I received the notice to keeper letter on the 15/05/2014 and the final reminder on the 30/05/2014 and sent my appeal letter using the template from the newbie forum on the 09/06/2014 sent first class and i have proof of posting marked on the 9th. So i sent the letter 25 days after the initial notice to keeper letter and they would have received it within the 28 day time period. However then on the 17/06/2014 i received the DRP letter instead of a letter regarding my appeal and a popla code as i was expecting.

    Do you know if i have grounds to complain to the BPA and will that help at all in getting this invoice cancelled. I am unsure of who i should write to next since the PPC ignored my appeal.

    yes , complain to the BPA and give them copies of the correspondence and the dates etc , like you have done here, plus any reference numbers

    your complaint will be its gone stright to debt collectors and no response to the appeal within the BPA CoP timescales , no popla code either so you have not had your chance and right to appeal it to popla , again a bpa cop breach

    then let AOS investigations handle it at the BPA

    as for the newbies thread, post #6 tells you all about code breaches and so about missing popla codes etc

    MattJeff - the PPC use the dates on their letters rather than the day you received it! I think you've miscalculated. The BPA do not care what day you received the correspondence (the PPCs use this fact). The BPA will look at the dates the correspondence were sent.

    I believe he had 28 days from receipt of the NTK to appeal it , so yes it was close but as there is no statutory time limit for this appeal process and as they have not issued a refusal of the appeal and gone straight to debt collectors then I believe he should still complain to the BPA and possibly the DVLA too (if you dont ask , you dont get) - let them decide !

    a POPLA code can be issued by a PPC at any time and I read on here recently where it could rise to a year in line with the EU proposals , but unfortunately that isnt a fact here yet so cannot be used at this moment in time

    so email AOS at the BPA , let them make a decision on this , which may make UKPC cancel the charge due to time and effort involved and yet again being investigated for possible sanction points

    sitting in your hands with your head in the samd is never a good option ;)

    Yes - do as RedX has stated. It seems UKPC might have breached CoP para 23.4. Accordingly it states they should have sent in the following order:
    1. Notice to Keeper
    2. Having heard nothing from you after 28 days, they are supposed to send you a Notification Letter
    3. It then states on (b) if a challenge or appeal has not been seen, then the final reminder should be sent after 14 days has passed from the Notification letter.
    4. After the final reminder, 14 days has to pass again before court action

    *this is probably in some stickie.....but have only recently been going through this myself. ;)

    Anyway get angry and write to the BPA and the DVLA, especially to the DVLA to stop supplying our details to thugs.

    if you wish to tell the ppc you are complaining to the BPA and the DVLA , by all means do so, or let it be a nice surprise for them
