Old Abbey National Debt ! Help pls

Hi, i have an old Abbey National Debt from 15+ years ago, it was sold to Equidebt and has now gone to Cabot, i have done a CCA request to Cabot and wanted to know what chance have they got of providing a Credit Agreement as the debt is so old ? I've read any paperwork is deleted after 6 years ! is this true. Any help would be appreciated. Can't go statute barred route as i've acknowledged this debt !!!

    Unless you've paid anything in the past 6 years that is....

    Was there ever a period of 6 years during which you didn't pay or acknowledge the debt is writing?

    Companies are free to keep paperwork beyond 6 years if there is a reason to do so. For example the account is still live or owing.

    No way of saying what they have held on to and what they didn't.

    Probable unlikely, but you never know. I've seen paperwork from early 80's or even late 70's produced in some cases.

    Although wait till they come back with a reply. I bet it says they are contacting the original lender and will get back to you.

    Hi, thanks for the quick replies, i have paid towards this debt until November last year and yes they say they will contact Original Creditor and that will take 40 days !

    Wont be SB then, but excellent chance there will be no paperwork after all this time.
    Wait and see what they come back to you with, then re-post if you need further advice.

    Hello there,

    Based upon evidence from callers I've spoken to over the years I think it may be difficult, although not impossible, for the information to be found. What's also on your side is that Abbey went through a significant amount of change and reform since the date you took out the agreement - it may be incredibly tricky for the information to be found. Of course I cannot say for sure but I would certainly be surprised if the original agreement can be found. You may discover that a 'reconstituted' version is supplied to you. Although this may satisfy the information request you have made it wouldn't be able to prove whether or not there is a legally enforceable agreement in existence.
