Has anyone successfully claimed sick while on holiday

Has anyone managed to claim sick during holidays and if so how do they go about it?
I was sick during a recent holiday, and wouldn't usually think anything of it, however, I've just been off work looking after family urgently and it seems that the employer is going to dock my pay. I'm wondering what the chances of claiming the sick leave within this period are?
Perhaps I'm just being greedy, but to be honest I'm less than impressed with my employer docking pay in an emergency! To clarify I'm not usually a scrounger, and have only had two days sick pay in the past two years.

How recently were you sick? It is unlikely they would entertain a claim for sick pay that was not notified to them in reasonable time.

I'm not sure why you would expect pay for emergency leave - you're not working so should not expect to be paid for work.

I have seen where it has been allowed but under exactly the same sick reporting requirements as if the person was at work (broken limbs was probably the most common reason).

I was sick last three days of May (during holiday period)
Had four days emergency leave last week - so all in the current pay slip

In answer to second question: To me, I see little difference between sick and emergency. I can see the logic of not paying emergency but equally not paying sick! Both situations are unavoidable, both situations you are not working!

By that do you mean that you need to ring in sick on the day you are sick?

You should definitely phone in sick on the day you are sick. And some employers want a doctor's sick note for even one day's sick when it's a claim during leave. Your employer should make the details available to you.

Did you follow the employers rules on calling in sick, if not unless you have proof (dr's note etc) then you have bob hope

Yes, I ended up with my leg in plaster on the first day (Sunday) of a skiing holiday, so when I returned I reclaimed the whole week's holiday and used it later in the year - this was in 1986 but I expect similar rules apply now.

The law meaning holidays could be turned into sick days was fairly recent so it was probably more likely your employer was being decent

  • I claimed it back but I was in hospital and still sick after my holiday had ended. I looked into it at the time as I didn't realise you could claim it back and what I should have done is called in sick that morning and kept evidence of my illness I.e. Doctors note or doctors visit. My employer would only reimburse illness which required some sort of medical intervention.

If you didn't notify them of your sickness at the time I cannot see them accepting it now, it just sounds like an excuse to offset the pay you will lose for the emergency leave. Most employers will cover 1 day of emergency leave but not 4, you should have a plan in place for emergencies for dependants. What was the emergency for and why did you have to be there for all 4 days?
