    Yes, and no.

    I've explained it to him several times, but he has a very delibarate habit of putting his head in the sand when it comes to any form of responsibility (apart from work, strangely).

    Thing is, I can't ask him to not work, because it'd reduce his income. His ex-wife pretty much took him for everything he was worth, and then some, and then built up a load of debt in his name .... so he's not particularly willing to trust anyone with his money anymore.

    Ironically, my ex husband was worth in regards to money, with me.

    I'm not communicating the problem very clearly, I'm aware of that - my brain is all icky today.

    I *think* I qualify under these rules:

    You may also get it if you meet all these conditions:
    • you have a partner and no one else lives with you or your partner
    • Carer’s Allowance is paid for only one of you
    • you both get the daily living component of PIP, AFIP or Attendance Allowance or the middle or highest rates of the care component of DLA
    I've just checked with my other half, and he is on the Middle rate of care, for DLA.

    Otherwise, there is Enhanced Disability Premium, on the same page you linked, which I'd never heard of.

    Now I just need to work out how to apply!

    But you provide 35 hours minimum care to him each week, how can he not see you as a partnership when you do so much for him?

    But you are entiltld to Income Based ESA, yes? Currently you receive no top up due to his earnings. To qualify for the SDP you both have to be in receipt of at least DLA middle rate, which you are. Would the SDP along with the CP not take you above the applicable amount of IB ESA?

    Your OH would have to be on middle or high for you to claim CA, so that's a given. Do others rely on you for advice? Where did you do your training?

    Sorry, I'm struggling to follow the last sentence. Are you basically saying that if I were to claim SDP it would take me above the income threshold for Income Related ESA?

    If so, we're already above it. I'm not receiveing any payments for ESA - only National Insurance Credits.

    You're welcome to discuss this with me privately. I'd prefer not to go OT on a post where I'm seeking help though. My new meds are treating my brain like a trampoline - I'm way too easily confused atm.

    OK my query regards do others rely on you for advice and who trained you was in reference to the fact that based on your own posts you do not seem to know the benefit system. Did I misunderstand when you said you were an online benefits adviser on ESA for 3 n half years?

    Regards Income Based ESA, the SDP, CP, EDP, premiums are not paid as additional benefits or income they are added to your applicable amount which is your basic allowances and any additional premiums. Any income is then deducted from the applicable amount and you are paid any top up. Currently you are already above this.

    Each additional premium increases your applicable amount which can result in you receiving a top up. Do you have a calculation to show that all of the relevant premiums were included in your IB ESA calculation? If so check to see the SDP may already have been included. If you have a mortgage they should also calculate this in with the assessment for possible mortgage interest payments. The premiums should also be included in any housing benefit and council tax benefit calculations.

    I take it any working tax credit is also paid to your OH? I appreciate you do not wish to discuss why you stay with him but if he has his DLA, earnings and WTC, does he pay all of the bills, rent, mortgage etc? If not is there an element of financial abuse here?

    Did you never receive CB ESA?
