Hi,

I was in the process of selling my home, 2 weeks down process, i have learnt that Solicitor has taken over by SRA for dishonesty.

The trouble i got is i have to collect my partial money i have paid to this solicitor as a fees.

Find a new one and pay the fees again.

And i have not collected any documents/files of my past dealings from the solicitor taken over by SRA .

I have found a new solicitor, luckily deal is continuing, but i have lost some money in the process?

More importantly. how do i collect my files from SRA?

The SRA normally seize the files and put them in the custody of another solicitor. If you contact them you should be able to find out where they have gone, although it may take time.

I believe the SRA keep them in their archives.

I believe you first of all have to try to recover the funds from their client account the solicitor had, then if that fails you have to apply to the SRA compensation fund

The SRA website has quite a bit of info on all this - I am surprised they were not more helpful when you called, or perhaps you were not ready to ask the right questions.

The solicitor who has been appointed as part of the intervention will gain access to all files etc, but be prepared for it to take a while for them to action your request to retrieve them - their priority has to be live cases so as not to jeopardise ongoing transactions.

Sorry to come back late on this one, but SRA is saying inorder for them to release the document, they would need a approval from my lender, but my lender is not interested in sending any such appoval to me or SRA.

I am bit stuck with this one, what can be done?
