Could they be any more incompetent?

What on earth is going on at the Insolvency Service? I went BR in May 2012, was discharged May 2013 and am currently working my way through an IPA that is due to finish August 2015.
I had another change in circumstances earlier this year which resulted in another income & expenditure statement being completed, and in the meantime my case transferred from Moon Beever to Clarke Willmott - and I have now been waiting about 2 months for the OR to review my case and decide what is happening with my IPA.
I am damned if I am having my IPA extended or am paying back-payments because of the OR's incompetence in sorting the problem out, what on earth are they doing at the moment? After 2 e-mails to CW without a reply I phoned today to be told that it is happening to a lot of people at the moment.....

did you send your I&E to moonbeever, clarke willmott or the OR? have you rang the OR in the last 2 months?Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

I put in a change of circs in Jan to take my payment from around £350 to below £80
I was put on the lower payment as an interim measure while the review went on.
I have just heard, this week (6mths) that they have agreed the new payment, without challenge, without question and without requesting further information. Last time, I had a hell of a job arguing the new payments with them
Whats more, today they confirmed that, as it is so low, I can pay the remaining 5mths in one lump sum and finish the IPA. (Offer from a parent to pay it off)
Are you on the new proposed lower payment? If so, they won't make you back pay anything, they will just start a new IPA from when you agree the new figures.
I'd sit tight and stick with the lower payments for as long as possible.0 -

Nope I never ring the OR, I always e-mail them so that there is an audit trail.
I sent my I&E to the OR. I then got a letter from CW saying my IPA would last 3 years from the month they received the revised I&E. I e-mailed the OR to query this and never received a reply. I rang CW who queried it with the OR. I then got a letter from CW saying I had had 2 long payment holidays already during my IPA (NOT true, my monthly payments were adjusted to NIL due to my I&E statement at the time). I queried that again. Nothing.
It is a comedy of errors....:mad::mad:0 -

I haven't paid a penny since my IPA started, as the sum due from my I&E statements has always been NIL - I had a new job when I went bankrupt which would have meant me paying £450 per month to an IPA, but I moved jobs very soon after so never have paid anything!
Every time my circumstances change I complete a new I&E (which has been roughly every 3-6 months since the IPA started) and every time it takes about 3-4 months to sort things out.
At the moment my payments are varied to NIL, but I have been spooked by letters from CW claiming I owe arrears for my IPA payments when in fact a payment holiday had been agreed for Feb-June this year by the OR. I have e-mails to prove that as well

If you have the OR agreement then you won't have back pay. They can only start charging once you have signed to agree to the amount. It's an Individual Payment AGREEMENT. They can't impose a payment on you without a court order.
They also can't extend it beyond 36mths, so don't worry about it being extended.
CW are just a collection agent. They don't make the rules.
Interestingly they are sending me a letter every month when I pay thanking me for the payment. No doubt they charge for each letter and add it to the IPA costs leaving less for the creditors at the end?0 -

LOL that just about sums it up GU
Thanks for the reassurance, I find it all so stressful
Roll on August 2015 when it is all finished, not long now

No they don't actually, they are paid as a percentage of monies recovered.Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

That's good to know. Seems odd to send a letter out each month though, must be an admin nightmare.0

They will be computer generated letters needing no more than the click of a mouse - printed out and put in an envelope by machine with all the other days post and mailed at less than you or I would pay for a stamp because large companies have pretty good bulk purchasing deals from the mail companies - that's what happens where I work anyway. Logically, its the only way they can receipt payments. Mail being returned via the 'gone away' system is also a good early warning system that someone is trying to evade payments...GoingUnder wrote: »That's good to know. Hurrah, we have finally come to the end of our 36 months IPA, (well my husband has, mine finished a few months earlier this year as my income had reduced due to my changing jobs). Have never heard anything from Moonbeaver to say they have been receiving the monthly amount (unlike GU here), presumably they won't send a letter saying the 36 months are now up, but we know they are, so happy days
