!!!!!! letters: response received.

Hi

I sent !!!!!! letters to 3 DCAs and have had 3 swift responses. One has sent me a financial questionnaire to fill in with my income/expenditure. The other 2 have said that I should call them. I'm unsure what the next course of action should be in each case as I know calling is often not recommended.

Any advice would be greatly appreciated,

    Stay off the phone.

    Ignore the I&E - only a Court can request to see this info.

    How old are the debts? whan was last payment made? CCA'd them?

    I have sent a couple of !!!!!! letters to DCAs too.

    Only mine weren't Full and Final Settlement letters...:D

    Thanks for responding. The debts are around 7 years ol and last payment was made around 4 years ago. I've been abroad so the DCAs stopped trying to contact me. Should I just resend the letters perhaps?

    You may have a hook in the 3 that asked you to call. In this case I would reply by letter noting their offer to discuss over the phone but, sorry you wish to keep it strictly in writing and ask them if they are willing to make a formal offer.

    "CCA'd them" means have you checked that they have the legal right to claim the money and that they are claiming the right amount.

    It is a good question. If you could demonstrate that they are lacking in one or both of those you are likely to get a better discount.

    Lastly, I hope you are aware of the pitfalls in full and final settlements, but the following link will give you some good reading if not.

    Thanks for the advice, I'll contact them in writing. What do you recommend that I say to the ones that sent the income expenditure form?

    I recommend that you find out how to do a CCA request. Google is your friend there,

    Either your letter was badly written and looked to them like you were asking for a complete write off (in which case they would be justified in asking for a I&E) or they are taking the mickey.

    My vote is on mickey.

    Harvey is right in that only a court can order you to disclose I/E details.

    However, you are asking them to consider settling a debt for less than you owe. They want to see that it is a fair and reasonable offer.

    If you want them to further consider the offer, give them the information. Otherwise run the risk of a CCJ

    Didn't ask for a write off but offered 10%. Maybe that was low in retrospect. I have no income so am happy to provide my income details...

    Up to you, but I would see the submission of an I&E as exactly that.

    A submission.

    It may well be OK, but if they put up more hoops for you to jump through then pull back and stop playing their game.

    Hopefully all will be fine. But I have a bit of a nagging feeling about this one.

    Its none of their business to see your I&E

    Writw to these goons to tell them that:

    1) You will only deal with them in writing as you don't own a phone.
    2) You will need pre paid envelopes to write back to them as you cant afford postage stamps.
    3) Ask them to clarify which Act of Parliment allows them to see your I&E.

    Also with the I&E just say that having completed the I&E form hey kindly sent, you can see that you have no money left to repay any creditor at this time. However, you will be in touch should the situation improve.
