Bankrupt but no one has called

Hi could you please give me some advice last Tuesday I was declared banrupt in court. I have been waiting since then for someone to ring and it,s making me very anxious. Futhermore I only get benefit payments , will they stop these and how do I survive until they ring . Also I panicked when on the phone to the benefits people and they said if I didn,t have a bank acount she would suspend my payments so in panic I gave her a very old cash card only account from Nationwide. As I never had a card or statement I had to phoned the bank up that day to get the account and srt code number. I only put my current accounts down on the forms as at the time when someone was filling them in all for me I had completely forgot about that account which had no money in it although no banks were owed any money. I would never of used this account unless I was put on the spot like that so also very anxious about that. Finally I have not opened any mail at all in about six mnths because of fear I have shredded them what do I do if debtors appear at the door. Thank you in advance for taking the time to advise me.

    Now is the time you can start to relax a bit and start to be back in control.


    Don't worry about the OR not contacting you yet, It was a week or so before I got a letter telling me when my Telephone interview would be, the main thing is you are BR and none of your unsecured debts can be collected.


    Your Bank Account should be fine for now, your Benefits will not be stopped, no different to salary, it will get paid into the cash card account, when you speak to the OR you should let them know about it and then it may get shut as that is Nationwide's discretion, before this happens get yourself to Barclays and open a new basic account, get everything bills wise and benefits wise going in and out of this account.


    You can do what you like with the mail for the last six months, burn or shred it, but it may be worth biting the bullet, opening it and contacting each creditor in turn and telling them you are BR, one phone call, tell them the date, court and reference number and they HAVE to go away, if they continue to harass you report them to the OR.


    If creditors appear at your door, do the same, tell them you are BR, give them the date, court and reference number, never sign anything or let them in, again fi they refuse to leave report to the OR or if they are door stepping you call the police.

    Thanks so much for reducing my stress levels , is it ok to use my dissablity money as I am severly dissabled and need this as without help I cannot manage as I cannot get out . Can the OR take my benefit money

    The OR can't stop your benefits, and you are OK to use them for any living costs as that is what they are intended for. The OR can't touch them.

    Thanks so much both of you the releif almost brought tears to my eyes.My mother is very old fashioned so it has felt as if I spent the last month as criminal. I am very ashamed so this place has been amazing to me everyday reading this board just to get through it.

    Keep in mind, if you are on benefits and your forms are filled out properly they may see you as a none priority if they are snowed under. They can't use benefits to create an IPA and if you have nothing of value they can sell, your case will be pretty straight forward and you'll have very little contact from your assigned OR.
