FOI request to Aintree after helping someone to deal with Trethowens.
I asked for the amount paid to Trethowens for the year 2013/14.
2013-14 = £99,660.69

Appalling. And just how much was recovered by Trethowans for the Trust? I bet not anywhere near the £99k paid to them! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Would have been cheaper to employ a part-time traffic officer of their own. Around £11-12k, with pension and uniform, etc, nowhere near the same amount.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0

The actual loss being chased (e.g. lost P&D tariffs - rather than the extortionate parking charges being levied for these alleged breaches) would have been even lower.
This is extremely poor financial management at best and IMO is misuse of public funds to the benefit of a private organisation.0 -
What it requires at Hospitals patrolled by ANPR is a patient of the hospital to pick up a ticket and then take the Trust to court for breach of patient confidentiality when that visit is advertised to the RK of the vehicle0

How would that be a breach of confidentiality?
Firstly, people go to hospitals for lots of reasons (visiting, working, cheap city centre parking in some cases), so it doesn't 'out' the driver as a patient.
Secondly, if a private company then the NHS has no involvement anyway.0 -
And if the driver was a patient then it does "out" the patient. Or do you think that someone's husband/wife will believe them if they subsequently claim to have been moonlighting at the hospital as a cleaner?
The PPC is the Trust's agent, and the Trust is fully liable for its agent's actions, including breaches of confidentiality.Je suis Charlie.0 -

Patient identifiable information - photographs
Taken on NHS property , of the vehicle/driver who is a patient and released without their consent . Yes , taken by a private company but as a contractor engaged by the NHS body who are ultimately responsible for all procedures and policy. The fact the photos may not indicate they are a patient is irrelevant . All patients have a right to expect their visit to be kept confidential .
I want someone do do this because I am convinced there may be mileage in it and whatever it may make hospitals think carefully before utilising the services of the likes of PE .0 -
There are several examples I am aware of where the PPC's are actually contracted by facilities management companies. A good example is the Queen Alexandra Hospital, Portsmouth where the Trust has no contact with the PPC who report to Carillion, the FM company. No breach there involving the Trust.
Could a hospital visit be "personal data"? If so, why need that be "personal data" any more than being at a Tesco's for 2 hours and 20 minutes? My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
