Advice please- quite urgent

Hello all

I'd like to ask some advice

A bailiff has come to my home looking for my partner- the debt is in relation to his business (ltd company) which has now closed they are trying to chase him personally- he has sought advice and is offering an interim payment plan 'under duress' while he is trying to get this sorted.

My partner wasn't home when the bailiff called- but my neighbour has just popped round and said that they knocked at her house and were asking questions- she has been very kind/ understanding etc the bailiff knocked and asked her about my partner- if she knew where he worked, and asked about his car (my partner doesn't have a car- I do- he doesn't even hold a drivers license)

Are they legally able to knock and ask neighbours questions like this? I think he should highlight it in the letter he is drafting to this dept collect agency and if possible would like some suggestions on how to word it.


He wants to get the letter sent off registered today so any advice I can get in the meantime would be great

  • Nope. Well not allowed to discuss your case with your neighbours. If your partner had put a interim plan in place the debt wouldn't have needed collecting it would have been sorted. I'd have thought they wouldn't be allowed to do continue to chase it after you've put a plan in place. I'd write to the company concerned and complain. Tell them that you're feeling harassed ad that any further contact no that the plan is in place is not wanted.


    You don't have to let any one into your house. Best plan is to not open the door to a bailiff and deal with them via post/email so you have written copies. Unless they have a high court warrant I was under the impression that you didn't have to admit them, and even then you can ask the police to come to make sure the other company is doing their job.




    Mind you... I'm no expert, I just hope some of what I've said is useful to you :)

    My partner took advice after the bailiff turned up he is now writing a letter to offer an interim payment under duress but we want to put something in there about them knocking next door but are unsure what to put.
  • There's a template on here somewhere if you google it. Or failing that, phone the company to put the plan in place and ask them to send you a transcript of the conversation via email for your own records.


    SO you had no payment plan in place before the visit then?

    No- no payment plan in place before they visited- writing to them now

    he just needs to know what to put in relation to them knocking at our neighbours
  • Just a line along the lines of
    'I would prefer it if you refrained from contacting my neighbours further with regards to this case. Should you need to discuss any further please contact me on xxxxxxxxxx or my nominated spokesperson Mrs X on xxxxx' that should do it.

    He has decided to just send off the interim payment letter and discuss the rest with the solicitor he is speaking to tomorrow.
