Help to clear off a Default

Hi Guys,

Looking for some advice really on what to do with this situation.

Here it goes,
I have had a Bank account with HSBC for over 6 years and i have used to for a lot of different things, but never really for any large purchase or huge spending sprees. I did the occasional betting on sports or going to the casino with my freinds but this was a very rare thing.

Then while i was away at uni for 2 weeks i came back home to check my online banking and noticed that within a week my card had been used over 80 times on Skybet and someone had spent over £3,500 on there.

I immediately contacted HSBC and they said they would look into it and after a while they managed to get all my funds back and that seemed to be the end of it. Then all of a sudden 4 months later i got a letter saying the transactions are legit and i was then debted for the money which they originally gave back, obviously as a uni student i didnt have much money coming in so this caused my account to go over drawn to over £2,500.

After trying to deal with HSBC and their fraud department they said the debt would be passed onto a external company and i would get notified of all of this.

Few weeks pasted and i didnt hear anything, few months go by still didnt hear nothing. As i was so busy with my own life i forgot about it but now after checking my credit file i noticed that i have a Default placed against my name.

Now i went to see HSBC today and speak to them about it and the woman i spoke to mentioned that the account was never passed onto the fraud department and it was dealt by a dispute team.

Now the problem i have is, 1 those transactions weren't mine and it was pretty obviously by looking my account history over the 7years that the account was held, I also never had any other issues with any Mobile phone bill, Utility bill or rent etc - No problems with the police also.

So my aim is to get the default removed off my name.. To be honest i am happy to pay off the amount just to get this !!!! all sorted and out of my life but i do not want the default to ruin my life.. Im getting married and obviously i want to get a mortgage etc so it would be a huge burden.


Any advice on what i can do? - Thank you

    Out of interest, when is the default dated? It stays for 6 years from that date.

    I would not pay this. Paying wont get rid of the default and it looks like you are admitting they were your transactions.

    I would send a written complaint to HSBC stating that you are unhappy they have logged a default as you have disputed the transactions.

    Also mention what the member of staff said about not passing to the fraud team.

    State you only wish to deal with this matter in writing so you have a copy of everything for your records.

    If, after 8 weeks they have not sorted it, call the FOS:

    If you feel you have already complained to HSBC about this, then just ring the FOS and skip the 8 weeks til they fob you off again.

    Do you have any advice on how i should write the letter?

    I do want to add in there that i had the account for over 7 years and i never had a single issue, i was a perfect bank holder and i feel as if i trusted HSBC in helping me but instead i was betrayed

    Want to write this letter this week really and try get this sorted :(

    You know the background to this, so you will have to put the facts down on paper.
    Don't forget to add the following :


    Ask for a complete explanation of events.
    Explain to them they were not your transactions.
    Ask why it was never passed to the fraud team.
    Ask why you were not kept informed of any developments.
    Ask why a default was registered against you, when you were a victim of fraud/identity theft.
    Tell them you want the default removing.


    plus any more relevant facts you have.
    Send recorded delivery to there complaints dept.

    Slightly different note, but would it be worth contacting the police, since this is obviously fraud on your account. Also do you have any insurance policies that might cover this, either yours or parents if they cover you ?
    Debt -it's a fight that I'm winning, dealing with debt one day at a time.

    as a side issue I dont understand how or why someone was able to use your account for skybet, assuming they did get access to your account any withdrawals could only have been made to your account so what really was the purpose?

    also if you didnt have £3500 in your account the transaction should have been declined
