    Just wanted to echo what Lensman and thewhiteavenger appear to have identified. It could be classed as contempt of court if you do not respond to certain requests (such as an order to obtain information) - that is what can lead to the threat of committal, rather than just owing the debt.

    On a separate note, you may not be aware that Amigo cannot ask the court to make an Attachment of Earnings against your ex, as members of the Armed Forces are exempt from this method of enforcement. This might help explain why they are pursuing you instead/as well.

    Anyway OP I hope that you have sought advice since posting, or at least got in touch with the court. You simply have to ensure that you co-operate with the court - you can't be imprisoned purely on the basis of being unable to repay a debt.

    Sorry for the long email but trying to get everything in

    First thing we really need to know if you are in England, Wales, Scotland or Ireland. I am commenting if you are in England.

    Contact to Debt Collection Agency (DCA) Company chasing the money to get your County Court Judgement (CCJ) reference. You need to know if they have a County court judgement against you. Once you know that go back to Step Change or National Debtline and explain your situation. I am not sure why Step Change could not help you or at least point you in the right direction.

    Do not let this “Law Enforcement Office” onto your property, unless the police are with them. Talk to them through the letter box, window, but make sure your doors (back and front are locked). If he still wants to arrest you make sure the police are there and they see the warrent, before you open your door to the POLICE not the Law Enforcement Office. You may want to call the police yourself, and tell them you are a single female with a young child being threaten, explain the situation to them.

    I have never heard when you go and visit the DCA, they always come to you. It sounds a bit fishy. What address is it? An office, his home! Look on google maps and check it out before you even think of visiting this person on his territory. Your safety is important.

    Just make sure you and your little one are fed/safe and all your living bills (rent/Council tax/utilities are all paid - those are the most important things

    Also don't be afraid to tell the DCA (if they have not got a CCJ on you) you don't believe anything they say when they try to intimidate/threaten you. Tell them you are debt forums and know your rights. These people are just trying to scare you into paying them.

    One other thing, keep reading this forum, and learn your rights once you have that you will feel so more under control. Some guys have found themselves in an awful situation, not being able to sleep at night ( like yourself), but with a bit of knowledge and help they have turn themselves around.

    Have you got a good friend/family member you can talk to? Someone who can be by your side when talking to the DCA.

    I am commenting from my point of view, having been in debt to the tune of £15,000. Went on a DMP with SC and 6 years later debt free, rebuilding my credit file. I totally remember how scared I was to speak to the DCA, now I love the challenge.

    There are loads of people that will be around shortly to help you more.

    PS Nearly forgot … make sure you get your money sorted out for your little one. Have you spoken to a DV charity about how to handle approaching your ex about getting the money?
  • My old best friend owes my over £5,000, I took out a CCJ with him, It transpires you can't force him to pay and because it is a Civil matter he can't be put into prison.

    I wouldn't worry at all about the Debt, You may be asked to go to court regarding it and have to pay a little back each month but they can't take anything from your home.

    If you have a Bailiff come to you home don't open the door, tell him it is private property and he legally has to go, Tell him you are going to court regarding this.

    I urge you to not keep worrying about this, get some rest and enjoy your daughter. It is not worth losing sleep over.
