    Probably, but a letter stating "already in dispute" is a simple return to shut them up.

    Still heard nothing,
    Is there a template letter for accounts in dispute, or is it a simple letter along the lines of,

    Due to the fact that the request made on the 10/6/2014 for my CCA to be forwarded to me has not been adhered, Please place my account on hold until such time that the CCA is received by myself at my address.
    Please ensure that this record of request is also evident on this file.

    Relax and wait, just the action of submitting a CCA request automatically puts the account on hold anyway.
    They will respond to you, one way or the other in good time.
    If no response within the next two weeks, just send a reminder of your request, that's it, don't mention anything else.

    Hi all,
    I have just received all my credit card statements since 2004, but not my credit card agreement. The letter they sent said they are still waiting for my CCA. What shall I do?

    Sorry, I can't agree with Sourcrates that a S77/78 request failure automatically puts the account on hold. McGuffick vs RBS established that the creditor can continue collection activity if a CCA request is in default. This includes request for payment and reporting on credit files.

    However, FCA guidance precludes them from going to court.

    All collection activity should cease on a disputed account though.

    I would consider sending them a letter thanking them for the correspondence so far but stating that they have not complied with your CCA request. You cannot at this point establish that they are legally entitled to claim payment. You therefore dispute the account and are witholding payment until your dispute is resolved. You look forward to the speedy resolution of this matter.
