Problem with settlement.

Hi all, just wondering if anyone can give advise on a problem I'm having.


In April I finally decided I wanted to pay off my car finance, so I rang up the company who it's with (Raphael finance/Southern finance) and asked for a settlement figure. The figure I received was around £2800, I told them that was fine and I would be ringing in the next few days as well as transferring the money.


The second time I rung up, just before hitting the transfer button, they told me in fact the settlement figure was only £2400, I informed them that if it was that due to the next expected payment then to ignore it due to me cancelling the DD (obviously to stop me paying the settlement and then the added DD amount), I was told the amount was correct and the DD amount had not been taken off. This was confirmed several times.


Today I decided I was fed up of waiting for the confirmation of settlement letter to arrive so I rung them up. The person on the phone confirmed the account had been settled and they would be sending out the letter with the next few days. All well so far...


However around 30/40 minutes afterwards I received a call from them stating that in fact I still owed them £400+ (the DD amount) and that I had to pay it asap. I argued with them down the phone stating that I had confirmed several times whether £2400 was the correct amount and been told every time that it was. I also mentioned that the phone call would have been recorded (it tells you when you first ring) and that they would see the proof when they listen back to it.


The woman on the other side was saying that I knew about the fact the DD was cancelled, which I've mentioned god knows how many times to them and the fact the whole mess up is my fault, therefore I'm to pay the amount immediately. It ended with me telling them to email me the amount owed and a copy of all conversations/interactions I've had with them. I then received a voicemail demanding my email address (which they've used to contact me before -.-). I rung up, only to have the phone put down on me every time (this was straight after I had given my account number).


Sorry for the long message, however I thought it best to include everything. Cheers for any advise.

    Regardless, the money is owed. Im afraid you will have to pay it. I would write a snotty complaint letter after this is done and I would also demand a settlement confirmation in writing stating that the account is closed and settled in full. I would guard that letter with my life and file it away carefully just in case they make another screw up and accidentally sell a non-existant debt to a DCA in the future.
