Littlewoods catalogue help friend going bankrupt and owes money on account.

    mmmm.. well if it was ordered on your account in your name then it would be your responsibility. The fact that it is in her name (but presumably still on your account) complicated things.
    Someone has said that you are encouraged to sell to friends? Do you have any evidence of this? Is there anything in the terms and conditions about ordering in a different name?

    I have a littlewoods account and placed the order for a 'customer' (my friend). I believed the account I had was an agency account so I could order for myself and others. Over the last couple of years I've mainly ordered online but when I have spoken to the sales line and placed orders over the phone, when I have said it's a customer order they have never said I don't have an agency account and have proceeded with the order. It's ordered on my account under her name and address as the customer.

    I would presume that's like me ordering something off Amazon for delivery to someone else.

    A lot of places allow you to place orders and have the goods delivered to another address, it does not change the fact that the account is in your name, and all goods ordered on that account are chargeable to you, it does not matter what agreement you had with your friend, that is a matter between you and her, and nothing to do with Littlewoods, im afraid to say, I know Littlewoods used to do an agency account, but I believe this was changed to a personal account a few years ago, mainly because, I would suspect, of many cases such as yours, you could contest this with them, but I don't think you will get anywhere with it.

    You say you have had the account for 10 years, I would send in a CCA request, its unlikely they will have the correct paperwork, even if they have, chances are there will be something wrong with it, ie, prescribed terms missing etc, no credit limit stated, no properly executed agreement, means they will be unable to obtain a CCJ against you in court !!


    Send CCA request, keep us updated as to what happens.
