Moorcroft - Mis allocation of debt

Me and my hubby bought a laptop a few years ago, to pay off monthly (not used credit since!) After a year, we went through some difficulty and a couple of dds bounced. The debt was then taken on by moorcroft, and we had agreed to pay off £50 per month. When we still had around £300 left to pay, we received a letter from Moorcroft stating the DD had been cancelled. After calling them, they confirmed the debt was paid. I requested a statement confirming, which they sent to me confirming there was a payment due back to us of £8.64.
Six months later, we receive a demand asking us to arrange payment. We contacted them and they stated some money had been credited to our account in error. As we would have now paid off this amount if we still had our original agreement, I was not happy and as it was their error, I refused to pay. We didn't hear from them after that.
We have received a letter recently from a different debt collection agency, which we stated the above. They replied requesting the debt still must be paid.
Anything anyone can help with? We have learned our lesson and now get nothing on credit!

Send them a copy of the statement letter confirming it's paid.
Tell them it's paid as per the enclosed agreement and if they disagree to consider this as a formal complaint.:beer:0 -
And if any other DCA contacts you about the same debt, just write back saying the debt is in dispute with Moorcroft and is the subject of a formal complaint, and don't bother me again !!!!

Update - we have now had a reply after sending the statement, they are requesting proof that the payments were made. As it was an error on their part, I did not make the payments, they misallocated funds. Does this an I have to pay as I can't prove that I paid?0

There are two issues here
1) You have acknowledged in your first post that you havent paid for the laptop and
2) Moorcroft credited somebody else`s payments to your account and told you (wrongly) that the debt had been paid, subsequently they have discovered this mistake, and correctly allocated the payments to the right account, which has made this debt reappear albeit with a different DCA.
Personally, I am of the opinion that the debt needs to be paid BUT you could go back to the new DCA and tell them of Moorcrofts error with the payments and ask for the debt to be written off (but dont mention that you knew you had stopped paying !).
If they still insist on you paying, then ask for a repayment arrangement that you know you can stick to.0 -
Is there still £300 outstanding then ?
You should dispute it, if your bothered about your credit file, make an arrangement to pay, if not, then I hardly think the DCA will push it too far, its usually all out for a while, then if they think you arnt going to pay, they quickly turn there attention to someone else.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
