NRAM total mess!

I've been having issues with Marlin and nram for such a long time now that I've even confused myself :(
Can anyone offer any advice on what I should do about my issue... Here goes...

My OH and I took out 2 similar amount NR loans in 2008. We got into financial difficulty in 2009 and started a DMP with CCCS. In the meantime NR secured a charging order against one of the loans ( let's call this loan 1) we continued paying to CCCS for the next 5 years, when we had the opportunity for a lump sum IVA. All went smoothly (as it could of course) we paid up the dividend, leaving only the loan 1 with the charging order which we've kept up the set payments on.

The problem started when nram passed the loan onto Marlin (Mortimer Clarke are dealing with it). Their balance and the balance I have are very different. I have finally received a breakdown of all payments I have made to them. They are missing about a year and a half worth of payments. When I've cross referenced these with my CCCS statements, it appears that payments were sent to many different companies over the years! (Ever sheds, fairfax and nram)

My worry is, where these missing payments being taken off the balance of my other NR loan ( loan 2)? Which has now been paid up in the IVA! Surely NRAM would've contacted CCCS if no payments were made to the Charging order loan for this long!

I have received a report of payments made to cccs for this account from stepchange this morning, which does detail all of the payments.

Is there anything I can do? What can I do if CCCS were sending the payments to the wrong account? Now this account has been settled in the lump sum IVA can I still get a detailed history of this account?

Sorry for the waffling post but I can't get my head around this mess :( the 'missing' payments are about £900 so not an amount I'd like to loose.

    You would still be able to get a detailed transaction history of the settled account by doing a subject access request under the data protection act if necessary.

    However I would start by writing to marlin (or whoever sent you the list of transactions for this open account) and dispute the balance and inform them that there are a number of payments you have made missing from their statement. I'd enclose a copy of the list you received from CCCS.
    At this stage I would make no reference to the other loan or the possibility that payments could have been allocated to that account.

    Thanks for that, a little too late for them knowing about the other loan though, as they are listed together on the stepchange statement and marlin now own the other loan also.

    I've sent everything to them so hopefully they will sort it from there.

    Got the reply I've wanted. They have agreed that the missing payments did go onto the other loan. They're going to amend my balance to take this into account.

    Only drawback is they are asking if I want them to speak to Marlin regarding the other account (loan 2) to increase that balance.

    How will this work? Bearing in mind that the other loan account was settled in the IVA. I just told them that I will contact Marlin myself to discuss this :question:

    If loan 2 was settled by an IVA then they can do nothing to alter that.

    I really think something should be done as the error is NRAMs not mine.

    What they will be required to do is put you back into the position you would have been in, had the payments gone to the right account in the first place, if they don't do this, complain again, if they still don't do it, get the FOS involved.

    Heard back from Marlin today, they have emailed me a statement dated today, showing the full balance minus the f&f IVA payment! Asking do I agree with this balance. My IVA completed in October and they are still not acknowledging it! They voted for the IVA in the creditors meeting, getting very tired of this now. I thought the IVA would sort all this out :(

    After months of stressing and fighting this I've finally got the result I wanted :) Marlin have checked back on payments made and admitted that about £1200 of payments were made to the wrong account. They have lowered the balance and marked the other loan as satisfied. So happy :):)

    The lesson I'd give to anyone reading in a similar position, keep at them and don't give up :)
