    IN practice you can be paid for untaken leave as there is no checking.

    all the boss does is risk YOU kicking off about it, fairly low if you asked.

    Anyway as a part timer there is a very easy way to do it totaly legaly.

    Whilst I would support anyone who wanted to take their full statutory holiday entitlement, I agree that if both employer and employee are content with an extra payment then I would go with that.

    The law does not say that holiday must be taken, just that the statutory minimum (16.8 days for the OP) cannot be denied. It does, of course, nevertheless say that, except in the case of a leaver, payment should not be made in place of holiday being taken.

    If the employer agrees to make a payment then this could be a simple additional payment which coincidentally equals the value of the holiday not taken. The employee should confirm in writing that they have not taken their full holiday but that they had given this up freely.

    In fact you are already working a legal system - taking holiday on your normal working day but replacing it (actually count it as overtime) on another.
