5year old debt....statute barred?....checking credit rating?

What is call credit on noddle??
I can't outright pay for any of them so I dont think I can settle like that. Is there a chance there could already be a CCJ in my name for any of them?
What is F and F's too?? I'm unsure of the abbreviations sorry!!
.
I'm thinking it may be best to go for statute barred as its only 8/9 months (i think) for the 6 year dead line ,check my credit on all 3 like happy bunny suggests, that way I'll know if theres any ccjs and will know exactly who I owe,and then wait to see what happens. With the risk of more letters coming through?
If I start ttying to pay them now,it will probably take another 6years!
Thanks for advice in advance0 -
Also sorry,what is a CCA request??0

Also sorry, what is a CCA request??
A CCA request is a request for a copy of your original credit agreement, on debts taken out prior to April 2007, the creditor must provide an exact copy of that agreement bearing your signature and have all the prescribed terms relating to that account shown on it, after this date the rules changed, if they don't/cant provide this, they cant obtain a CCJ against you for non payment.

Dear Sir/Madam
Account/Ref No:
With reference to the above agreement, I/we would be grateful if you would send me/us a copy of this credit agreement and a full breakdown of the account including any interest or charges applied.
I/we understand that under the Consumer Credit Act 1974 [sections 77-79], I am/we are entitled to receive a copy of any credit agreement and a statement of account on request.
I/we enclose a payment of £1 which represents the fee payable under the Consumer Credit Act 1974.
I/we understand a copy of any credit agreement along with a statement of account should be supplied within 12 working days.
I/we understand that under the Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with the request for a copy of the agreement and statement of account under these sections of the Act.
I/we look forward to hearing from you.
Yours faithfully
Your name.

sending CCA automatically puts your account on hold while they fulfil your request, so buys you some time, but, as you are five years down the road to the six year statute barred point, it would also count as acknowledgement of the debt, so could start the would ticking again.
I think there is a website somewhere that lists CCJs but cant remember what its called.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Trust online you can search for CCJs.
Not all CCA requests acknowledge the debt. Depends how they are worded.:beer:0 -
I'm even more unsure what to do now. I'll have to think about it all and this new info.
If you guys were me now though, what would you do??0 -
a CCA request could be an acknowledgement of the debt as far as i can find it has never actually been tested in a court case but i think i've only heard of one case on another forum where it has been used to reset statute barred date but they argued against it successfullyThe only people I have to answer to are my beautiful babies aged 8 and 50

I would check all 3 credit reference agencies to see what my report says.
Then report back.:beer:0 -
personally i would
1) check credit files
2) check trust online
3) deal with any CCJs you find ASAP (hopefully you can miss this step)
4) for anything taken out before april 2007 CCA request them
5) the problem is any taken out after april 2007 you can either wait it out and hope that they dont try to take it to court OR CCA them (not the overdraft) which can buy you some time OR call them (DO NOT WRITE as this will reset the clock whereas a phone call will not) and see if you can get a cheeky low settlement offer go for 25% and see what they say to that say money is coming from a third party (get them to confirm any details in writing before you make the payment)
what are the balances and do you have any way of raising funds?
if you can afford to pay off any that possibly go for a CCJ if you pay it off within a month you can get the CCJ removed from your credit fileThe only people I have to answer to are my beautiful babies aged 8 and 50
