employer didnt pay my tax!!!!!

I worked as a nanny (responded to an ad on gumtree) for approx 4 months. I was paid cash which I believed was normal for nannies.

I assumed my boss paid my tax and national insurance, as they told me that I was on a net salary of minimum wage.

However I just received my p60 after starting a different job, and my only declared income is from my current employment! So my old employers did not pay my tax or national insurance!!!!!

I only earned just over 3k if that, so I would have been under the tax threshold for the year anyway, but I earned usually about £200 cash a week which is over the weekly amount

What should I do?

    I rang them today to discuss tax credits and the only income they have for the year is from my current employer, but my ex employer was in the same tax year so should have that income too.

    I suspect the above is correct, although I'd share your concerns that it hasn't been paid if you haven't had a P45 from the previous employment - if they haven't done that they probably didn't do anything else either regarding payroll!


    If your total income is below the £10k threshold then you won't owe any tax - the question is whether by them not reporting your income (if that is the case) you've lost any NI credits for pension purposes (which would be relevant if you are not in receipt of child benefit as I think you get it credited automatically if you are). Give the tax office a ring and explain that you had this earlier job, and ask if they have any record of it on their system.

    Bet they didn't have employers insurance either.

  • what is RTI?

    When I got my renewal pack they had my income as 3375, which is what I earned in my current employment (it matches my wage slips and p60 to the penny)

    All income from my old job and this one would be around 7k for the tax year, maybe just over.

    I do get child benefit, so does that mean my NI is automatic?

    RTI = Real Time Information - employers are supposed to report payroll details to HMRC via their online systems on a weekly/monthly basis - its to enable Tax Credits etc to be kept up to date rather than having an annual pay statement via P60.


    I think your nanny job has gone under the radar and probably isn't on your tax credits records. You probably need to declare the other income at least to the tax credits people and personally I would report the previous employer as not having operated payroll correctly (report to HMRC) and let them deal with him/her accordingly since they've clearly pocketed the tax and NI you were told had been deducted to make your pay net. They were either ignorant themselves of payroll rules or more likely assumed you were and they'd get away with it.
