Bailiffs coming to my mom's house

Hi all

I have many widespread debts totalling £30k, some bank loans, payday loans, overdue phone payments, take your pick.

I have had this for about 2 years and have not responded to a single letter for 18 months.

I own absoloutley nothing, I work but what I earn I spend ( its not a lot ) I live between my 2 parents, sometimes im at my moms sometimes im at my dads. But im registered at my moms.

Anyway my mom accidentally opened one of my letters, I have had hundreds of balliff letters before - but this one clearly states baliff's will be turning up at my moms house on 7th June.

The car I drive is a company car leased through my wages. Nothing at my moms house is mine. If you stripped me for all I was worth you would be lucky to get £50.

I was going to tell my mom to return the letter "not known at this address" as if they do come, she will be very intimidated.

But she is worried about lieing as I am registered to that address and do live their some of the time.

I do not want them to turn up at my house. Tbh I am going to be suprised if I do - because I dont have a penny to my name.

My mom is very easily scared and I want to prevent this happening - how can I do so?

If they do come - how is it best dealt with?

I appreciate that ignoring these debts for this length of time isnt the best idea, a reminder about this is what I need

But I am most greatful for advice?

    When you were unemployed in December I can understand not being able to repay your debts, but now you are working you need to contact the companies you owe money to and start making repayments to them.

    And 18 months ago you had savings of £17500, have you eaten the money?

    Dont be in on that day, tell your mum to be at a friends house, if she is going to be in on the day then close the windows, lock the front and back doors.

    re the last reply, maybe start making payments to teh debts, get a second job if need be.

    Is the letter regarding a bailiff visit from the Court as a result of an unpaid CCJ, or is it from the debt collection agency?

    Debt collectors are not bailiffs, they are private individuals working for private companies and have no legal powers whatsoever. They often wear uniforms etc. to make themselves look more official.

    Court-appointed bailiffs are different and do have certain powers. It's important to know who you're dealing with.

    If the former, write to them telling them that you will only communicate in writing, that they are only allowed to visit by prior appointment and that you have no intention of making such an appointment.

    Use the following letter

    Dear Sirs,

    Account No: XXXXXXXX

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Your Name (Typed - NEVER put your signature or any form of handwriting on a letter to a debt collection agency as they could scan it and use it for all sorts)

    Judging by your previous threads, you need to speak to a debt charity and deal with your problems and sell any shares you have to help with the debts.
    "Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!

    It's also a term for mum in the West Midlands.
