littlewoods and capquest

help ive finally got my finances in order only got one debt left at 0% of £4800 (thanks gran)which i am paying off
anyway i got a letter today from crapquest stating that i owe £300:67 for littlewoods mail order finance
now i have never used a catalogue and when i tried to speak to them just now they would not talk to me unless i gave them my dob when i refused he just said bye and hung up so now what
do i try again and give them the details or what and try to sort this
If we can put a man on the moon...how come we cant put them all there?

    Have you ever used any catalogues because Littlewoods own a lot of other catalogues?

    never have never will use any sort of catalogue
    it cant be anything else other than a catalogue as ive never bought anything mail order

    Then in that case you need to get them to prove there was a debt others will be able to come in and quote letters etc you can send but sounds like you don't have to worry too much so long as you don't accept you owe them anything.

    Here is a template letter (dates need to be edited) that was posted by the user PhatBear in another thread recently. Think it came from weller or angeldavis originally.



    If a debt colecting agency is chasing you send them this:

    I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose £1 in payment of the statutory fee.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.

    4. I would also like to point out that under the Limitation Act 1980 Section 5 “an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities, therefore if I do not receive evidence that I owe your company any monies by 6th February 2006, I will have no hesitation in passing your details to the Office of Fair Trading.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.

    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.


    The date is 12+2 days after you post it.

    if they fail to provide the CCA in the time frame they are breaking the rules.

    if they contact you again re a disputed debt, they are breaking the rules.

    Once the date has passed, add another 30 days and you can send a further letter telling them where to put their demand for payment.

    Hello,

    After receiving a letter from the 'Telogram' people that led to the CapQuest letter ect I found this site and folowwed the advice.

    I will have to explain I have visual dislexia, so my typing and spelling may not be the best but I have tried.... this is the reason I mistook the initial letter from 'Telogram' as I did not see the O and thought it said Telegram.

    I sent a 'prove it letter' with enclosed postal order etc.

    They have now replied with a new tactic (laughs) here is what it says...

    We thank you for your recent communication requesting copy documentation on your account. We have requested the documents from Littlewoods Finance Company and we expect to recieve them shortly.

    Whilst we wait on Littlewoods responce, we have selected your account for a pilot sceme that we are currently undertaking that will save you time and money.

    The pilot sceme consists of offering you a one of settlement amount to clear this account by 23rd Jul 07. We are ofering you a saving of 75% of the balance of your account.That means you pay only £30.65 in a one off payment, and your liability will be cleared.

    No catch, the sceme is to reduce administration time and obviously cost involved.

    Your account is curently registered as a default against your credit file, however should you take up this exeptioanl offer we will immediatly take action to inform the credit reference agencies that you have'short settled' your account and to amend your file immediatly.

    if you do not wish to take up this offer, and do not make suitable payment plan once you have received the requested documentation, your account will be fast tracked into litigation.

    please contact blah blah telephone number etc.

    So as you can see by that they are now trying to get people to pay or admitthe debt by giving this oh so excellent 75% off rubish to get you to pay.

    Sorry CapQuest I may be dyslexic but im not stupid!!!! I hope this post will add to the help and also show people what these idiots will try next.

    yep i got this letter today too
    i shall ignore it as why should i take up this offer when they still have yet to prove its my debt
    and funnily enuff this "offer" ends on the day they got to get me my proof of ownership strange that innit?

    i got another letter today stating

    "further to recent contact with our office and your request for further information in relation to the above account, we would confirm that your account is now on hold for 28 days whilst we obtain the information required.

    if you have any proof of payments or correspondence that would assisst with your query, please forward these documents, with a brief covering letter to our collections administration department, so that we can resolve this matter as soon as possible"

    now considering that ive already told them that i do not acknowledge this debt as its not mine why would i have any proof of payments/correspondence?

    and they have still only got til 25/7 to get the proof to me before the next letter goes off, i will NOT let this matter rest

    OH cannot believe how strong i am re my debts/ money ive become since joining this site, so thanks all
