Will she have to pay for her partner's child

Options
Wonder if anyone can provide an answer to this? My sister's partner has been unemployed for a while and was claiming JSA but this will stop shortly as her earnings mean he will not be entitled to any benefit. He has a child with his ex wife and has been paying voluntary maintenance to her. My question is that when his JSA stops and he has no income will my sister be obliged to pay the maintenance?

  • No your sister doesn't have to pay for someone else's child.

When I was moved onto Income Based JSA and was awarded £4.70 (or something like that) - I contacted the CSA and they decided that I couldn't pay.. My partner wasn't asked to pay anything..

    So I would say no..

the partner needs to ask for a re-assessment based on nil income.
If you've have not made a mistake, you've made nothing
  • There's no mention of the CSA - is this a private arrangement?

If he was still living with his ex and the same situation arose, he wouldn't be able to magically find money - the family would have to manage on the lower income.

Until he finds work, he won't be able to pay anything.
