when to use a cca

hi, i have a question in relation to cca requests. can a cca request be done on a dca in relation to a bank account debt.

    yes of course, why ever not... no cca, no debt enforceable.

    hi, sorry for all the questions i just feel i need to get it correct first time.
    if you have more than one debt with a dca ,do you have to send a cca request for each debt.
    also i have been made an offer from hsbc for charges and now find i am being chased on a daily basis from metropolitan collection services.would and should they advise my personal offer to them?

    You send a CCA request for each debt, no matter if it is with the same DCA.

    Not sure about the charges issue though, if HSBC were going to pay you direct I wouldn't have thought that the DCA needed to know but you may well find that they pay the charges off the debt if that makes sense, in other words inform the DCA that your debt will be reduced due to charges being refunded.

    A CCA request only applies to a single credit agrrement so if you wish to query several then you need to send one request per credit agreement.

    Your second question makes no sense to me.

    hi, the hsbc offer states they will send me a cheque within 14 days,i have also rung them to confirm this.
    the account this offer relates to is closed and the outstanding debt passed to a dca.
    since this offer has been sent i am saying that the dca has been constantly ringing me obviously aware some money is due my way.

    Are you sending a CCA to the DCA that is dealing with the closed bank acount. Either way, as far as I am aware, you are under no obligation to inform them of the cheque coming your way and a CCA should shut them up if that is the case.

    if so they surely cant use the excuse that they have requested the cca from the original debter as they are one and the same.

    I am pretty sure that HSBC own Metropolitan - I had the displeasure of having to 'deal' with these people, and the Customer Service Manager at HSBC told me that they were part of the same company.
    However, I would advise treating them as a separate company, but copy all correspondence, with them, to HSBC.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
