Help With Old Debt!

HI.
I have read thorugh alot of the threads on here and cannot find the answer to this question:
I have got a debt with Aktiv Kapital, I have asked them for the orignial credit agreement via a debt collection agency. The agency told me that their client (Aktiv) do not have the orignal agreement.
I have been paying a nominal payemtn to them.
Does this mean the debt is unenforcable?
