Loan/ PPI/ Debt Collector
Good Morning Forum,
I am hoping that some one has a little expertise in a problem that I have as I am not sure which direction to take.
Apologies for the length of this post but I want to explain this fully.
In 2005 I had a £750 loan with Welcome Finance which also included PPI. Repayments were not a problem until mid way through I became seriously ill with a brain condition (can explain more if needed) which left me in hospital for a short while and 12 months off work.
During this time my elderly mother had to take control of things for me as I could barely speak or understand anything let alone deal with everyday things.
At some point during this period I signed some documents with WF to take into account of my inability to maintain payments and carried on paying reduces payments. Although I did not have the original agreement anywhere something in the back of my head told me I had PPI so I stopped payments and requested all documentation from WF.
All they ever sent me was the second agreement, which turned out to be a renegotiated loan, but not the first. Three years and numerous debt collectors later I finally have the original document which does show PPI on the agreement.
Obviously I am a little confused as to why WF did not advise that I should use my PPI but instead saw fit to renegotiate the loan instead? If I had claimed the PPI then it would have been paid off and not stand at what is just over £4000 as it is today. Which leads me to believe that someone somewhere was aware of the PPI and tried to hide it.
At point I was told that the original agreement had been destroyed, which I refuse to believe, I am still refusing to pay and I think I need some legal advice but not sure where to go - any advice would be extremely appreciated.
