Ex wants half the house but hasn't paid anything towards mortgage

I wrote to the Halifax Building Society in 2011 when there was a question over delayed mortgage payments to
explain that I am in no financial position to take responsbility for the house in Scotland, I already pay rent & costs
for my house where I now live in England. I advised the Halifax in that correspondence that I give my agreement
to any repossession that might result from missed mortgage payments, effectively I voluntarily surrendered the
property to the Halifax/BOS at that time. If Mr XXXXX defaults on the mortgage payments then I will not fight any
repossession activity that you must take.A friend is someone who understands your past, believes in your future, and accepts you just the way you are.0 -
Woah don't offer her a %! Offer her her original contributions and nothing more unless a judge orders it.
People are scaremongering you a bit here. I work in the legal sector & no judge in the land is going to force you to sell & put you and your children out on the street when you can prove your other half has made all the payments.
Let her take you to court - that way she pays the fees. But go with the robust approach, start putting together all evidence you have to show that it's been your other half making all the payments. Bank statements, a letter from the mortgage co... the works.0 -

Thank you so much for your response, I have a significant amount of evidence to show she has not paid towards it. Also the letter she wrote to Halifax asking to be removed from the deeds. We have an appointment with the solicitor tomorrow to arrange what we should send her as an offer. If she declines we will let her take us to court (as you mention she will have to cover the costs) I will sleep a lot easier knowing my children have a roof over their heads. Thank you.0 -
I disagree.
If she does not take you to court and something happens to your partner you could find your out of house and home.
