    She doesnt want to remain in the house for certain. If she would rather sell then so be it. I am confident she would get less, but at this point I dont care, I want this process to be swift and painless.

    Then how is 10k a suitable payoff? If there is up to 28k equity, she put 5k down originally, she won't have anywhere to live with your children to call 'their own'... 10k is WAY OFF.

    10k was before I knew how much equity was in the house. Once I called them I decided to offer 12k.

    The children dont have to go with her either, I would have custody, but she wont allow it.

    Before you go burning your bra at me, bare in mind you have no idea of the situation at all. Just because I am male, doesnt make me in the wrong at all. She wants to move back near her family.

    You're probably more than happy to cover maintenance to the kids as well.

    I hope you get it sorted but as i've discovered myself, you probably can't get much in the way of advice on here unless it a mortgage specific advice you're after. Anything legal etc and you'll need to fork out for a solicitor.

    There's no question of being right or wrong in these situations. Ultimately it's a matter of compromise. Otherwise all the equity will be wasted on legal fees.

    She has completely changed her whole mentality and decided to be civil about everything.

    We have agreed 14k and split half the fees which seems fair enough all round.
