paid when not needed

just a query, my hubby (PWC = parent without care) has worked sporadically for years, jobs are hard to get where we are but hes always been joined to any agency and took any work. when hes been out of work iv always paid £40 a month regardless, so at times wen hes been out of work and £0.00 is due but £40 has been paid, will this get taken out of any arrears if any ?

    I wouldn't have thought so. It was his (your) decision to carry on paying even when there would have been a nil assessment, especially if you didn't inform CSA he had no income at the time then they'd be none the wiser.


    It would be like paying off a lump sum of a mortgage. For example, in January you pay £5,000 towards your mortgage but February you make no payments, that is still classed as a missed payment and will incur arrears.


    Of course, I may be totally wrong, but that's how I'd look at it. Hope for the best, prepare for the worst.
