CSA NRP Tax free work

To put a long story short my husband is a gambling addict, we are currently separated and he pays maintenance via csa.

I am looking into a divorce, not because i don't love him, but because his addiction and the subsequent effect on our family is getting too much.

Anyway, he is planning on leaving his job next year and has stated interest in overseas security work, where he will be paid into his uk bank account, but will not have to pay tax as the company (british) his overseas.

I have read a bit about this and from csas point of view it doesnt look like i will be entitled to any maintenance.

With that in mind, could i, based on my husbands future career, stipulate as part of the divorce maintenance payments for the children as i will not get help via csa.

You could seek a Court Order for maintenance - this would then be in force for at least a year before your ex could apply for an assessment via CSA.

As she already has an existing case with the CSA, and clearly doesn't meet the grounds for a top up order, I wonder if the courts would actually make such an order? Without re-checking the law, my gut says there's something that prevents them from doing so when the CSA already have jurisdiction.
I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.

I wouldn't worry too much OP...no security company especially one that operates abroad is going to employ a gambling addict. Also i remember it used to be the case where an NRP was employed abroad but paid by a UK based company was still liable to pay CSA...don't know if that is still the case but can't imagine it has changed.

She would have to close the case with CSA before attempting to obtain a Court Order.

Thing is no one knows about his gambling unless i tell them. Dirty little secret I expose!

I'm pricing up solicitors at the moment so will see what they say. He wants the divorce yet I need to fork up the money to pay for it! I'll be the 'B' sending him papers while he's in Afghan too. Blah had enough already.
