moorcroft and catalogue debt

Hi, help please because I'm at my wits end. I have been dealing with CCCs and creditors since October and with the exception of a certain credit card compnay ..NA things have ticked over but in February I asked for a copy of my credit agreement from my catalogue and they failed to provide it. I contacted the catalogue and disputed the amount owed. In good faith I agreed to send £1 per month once eveything was sorted and they agreed to it. I asked for statement and a breakdown of debt which I never received but sent PO and a letter asking for them to set up SO every month - sorry if this is confusing. I held off last month to see their response and this morning I had a lovely letter from Moorcroft who knew nothing of this arrangement and are preparing court papers for me. Can't contact the catalogue until Monday but feel I am back to square one and that eveything I've done is useless. Sorry but this is just too much. I rely on this site so much so please help me

    Your objectives here are little unclear.. you have asked for signed credit ageement and not received them but agreed to pay anyway.. very confusing.

    If your objective is not to pay, then write to Morrcroft demanding a copy of the signed agreement and a statement of account and saying that its absence will be used as a complete defence if they go to court.
    Pay no further money.

    If you have a different objective then tell us what it is.

    Hi, who do I contact tomorrow Moorcroft or the catalogue. Rang Moorcroft who never mentioned anything but income and expenditure form. The catalogue credit department set up an arrangement of £1 a month but I still disputed amount owed. They couldn't provide a credit agreement and so I sent no payment. Now they have passed it to Moorcroft who are threatening litigation. How feasable is this threat?

    Not very - CCA Moorcroft tomorrow and you may well find that they pass the debt back to Littlewoods who more than likely will not have a CCA. Moorcroft make a lot of empty threats, scare tactics to get you to pay and it hardley ever means anything so don't worry. Without a CCA they can't enforce the debt in court, its as simple as that. You are quite within your rights to stop payments after the 12+2 days have passed.

    Anyway get the CCA off to Moorcroft tomorrow and make sure you send it recorded. Please don't worry, they are just trying to frighten you, they are bullies!!!!!

    If catalogue defaulted by not sending a signed agreement (I requested it in February) how does Moorcroft now have the right to threaten?

    Lack of a CCA is a complete defence in law.

    Write as I suggested above... if you need a proforma letter repost tomorrow.
