Engage Credit-Data Protection

Hi, Sorry if this is a long one but i'm looking for advice, i'm not sure if this is the right section to ask but here goes.........
I had a mortgage with my ex partner with Future Mortgages but the account was sold to Engage Credit in December. My partner and I have been split up for nearly 5 years but still get on and for various reasons didn't get round to transferring the mortgage to my name.
My ex partner hasn't paid anything towards the mortgage since we split up and there for didn't know the answers to the security questions - Engage still discussed the account with him. Now I know that as his name was still on the mortgage he had a right to discuss it but I am concerned that having failed security they still discussed the account with him.
A couple of weeks ago we filled in all the transfer of equity forms and sent them off so were just playing the waiting game to see if my new application on my own was accepted. I received an e-mail from ex partner yesterday which read 'your mortgage got approved, just got to get the paperwork to solicitors now', I e-mailed him back and asked how he knew as it was my sole application and I hadn't heard from them his response was 'I spoke to Engage and they're posting the forms to you'.
My issue is that as it was an application in my own name surely they shouldn't have discussed my application with him and notified him that my application was accepted before they'd discussed it with me particularly as there was a password on the account - which he didn't know? Is this not against Data Protection? They've tried to say that as his name was on the original mortgage that they are allowed to discuss it with him - which I understand to a certain extent but surely they shouldn't be telling him whether my new application has been accepted?
I'm just a bit concerned about their confidentiality now.

I dont think this will be classed as a new application more of a change to the existing mortgage.
So until his name comes off the account completely, he is still party to the information? I assumed that as I'd had to reapply, be re credit checked etc that it was being treated as a new application, therefore only the old account and not my new application should have been discussed with him? Maybe I'm wrong though.0 -

No doubt your ex wants off the mortgage as soon as possible.0 -
The posting of the forms wasn't the issue!
It was the fact they discussed my application with him!
And clearly he doesn't or it would have been done before now!
I posted for genuine advice not sarcastic comments!0
