in Loans
I know I am appearing on here as a Newbie but I have been a member of MSE for a number of years. For some reason I am not getting an email that would help me reset my password but that's another story.
A long time ago we took out a secured loan with the Halifax running over 180 months. A couple of years into the loan OH was made redundant and we missed a couple of payments which ended up with the insurance being cancelled and we were unable to claim (that's another story). A bit further into the loan and OH was made redundant again and we missed another few payments. We arranged a payment plan with them to pay off the arrears and had a phone call a couple of months ago saying that the arrears had now been paid off. This, we thought, meant that the loan should have ended in February of this year. To our horror we then received a statement which shows that we still owe of £5k which will take another 1 1/2 years to pay off. I rang the Halifax and asked for a payment breakdown for the whole of the loan so I could see where this amount had come from. They duly supplied the statements but for 5 years they are only showing a yearly payment. I asked for a breakdown of these years and they are now telling me that it is not possible for them to supply them. During these years (2002 to 2007) my OH used to go into the branch once a month and pay cash. Does anyone have any advise for me? I have written to them asking that they supply monthly payment breakdowns for these years but have not heard anything. If I ring up I am mysteriously 'cut off' when I explain the situation.
I would have thought that if the arrears from the months we had missed had been paid up then these payments would have bought the account up to date. No-one at the Halifax can tell me where this other £5k has come from and are just telling me that we must owe it. I'm getting really frustrated now. We are carrying on paying so we don't get into trouble again but can't understand why they can't/won't supply a payment breakdown.

When you were on a payment plan to pay off arrears, were you also paying your normal monthly payments on top of this?Baggiebird2nil wrote: »I know I am appearing on here as a Newbie but I have been a member of MSE for a number of years. It sounds like your payment plan has been to pay off arrears that existed at Date A, and then in paying them is it possible you weren't paying your normal monthly payment between Date A and Date B, and now those are in arrears?"Facism arrives as your friend. Yes we did carry on paying the normal loan and an overpayment of £60 on top of that.0

Have you not got your own copy of the annual statements for those years that you can compare the annual numbers they have given?
If you haven't already I would sending a subject access request under the data protection act.
If they do have a breakdown of the payments and balances then they will send them in response to a SAR - template here - https://www.nationaldebtline.org/EW/factsheets/Pages/39%20EW%20Credit%20agreements%20-%20getting%20information/Page-06.aspxA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Hmm, that does sound a bit strange then. Do you have any annual statements?Baggiebird2nil wrote: »Yes we did carry on paying the normal loan and an overpayment of £60 on top of that."Facism arrives as your friend. Like a dimwit we never kept them. I will send a subject access but it just seems strange to me that for the first 2 or 3 years of the loan we have a monthly breakdown, then between 2002 and 2007 it is a yearly breakdown, and then it goes back to monthly again!
Thanks for you advice.0 -
Subject Access Request is the best bet, I would say then. I think they can charge you £10 for it, though."Facism arrives as your friend. Hello there,
Do consider making a subject access request, hopefully that will help you get a little more information to shine some light on what has happened.
Can you remember how much you borrowed, and when you took out the agreement? Finally, would you be able to confirm whether or not Halifax were your main mortgage lender?
Thank you,

Hi David - Yes we borrowed £21,000 in January 1999 with a term of 10 months. We have been making overpayments of £60 a month since September 2011 and are still paying that amount and from January 2007 until September 2007 we overpaid by £18.67. I know that we missed payments due to OH being made redundant but what is bothering me is that they say they do not have monthly payment details between 2002 and 2007. Even one lady I spoke to at the Halifax said it sounded strange but when I ring and ask to speak to her she is now mysteriously busy and never returns my calls. I will be making a subject access request. Thanks for your interest0

Oh and yes the Halifax were our main mortgage lender. The mortgage was paid off a couple of years ago.0
