Helllo everyone,
Im having problems from Moorcroft Debt Recovery at the minute. I'm receiving several letters and endless phone calls every week. the most recent letter states i owe them £581.01 and if i don't contact them immediately it will increase to £731.01!
This is all from a Next account i got years ago, which upon signing up for i never signed anything. i ordered lots of clothes on credit and sent loads back and paid off loads and ended up having no idea where i was and when i asked next for breakdowns of my purchases, payments and returns they provided me with nothing.
from there i just left it and next passed my "debt" onto “Brecon Debt Recovery” who i believe are a company of Next's. I received an email from Brecon on 20/12/2013. in the email they wrote;
"Our Client, Next Retail Limited, have instructed us to recover the amount outstanding on your Next Directory Account of £.0.
We have been given full authority, where necessary to instigate legal proceedings against you. This could involve either an application for an attachment to your earnings order with your present or future employer, or an application for a warrant of execution by bailiffs against goods owed."
After reading that i forgot all about it, it's only within the past few weeks I've been getting harassed by Moorcroft who are saying they have been passed this so called debt.
I hate phone calls so if they can be avoided that would be great.
Any and all help and advice any of you have would be greatly appreciated. Thanks

Hi,
Send them this letter :
https://forums.moneysavingexpert.com/discussion/2607247
this asks them to prove any debt that you owe to them, tweak the template to your own circumstances, they should provide you with evidence, statements etc, also include the following paragraph :
Please note, all future contact must be made in writing only, I will not deal with this matter over the phone, please remove my number from your systems.
see what they come back to you with.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. thank you very much for your help! i am editing this template as we speak..
i was just wondering, would it be worth mentioning that i received an email last year stating that i owe them nothing? or possibly adding this email to the letter? or should i save this for when they get back to me? i don't want to use my big guns as it were prematurely!
thanks!0 -
Hi,
You are right to request information about the debt. If you have an unsigned credit agreement taken out prior to April 6, 2007 it may difficult for the creditor to successfully sue you.
You can request a copy of your signed credit agreement. You can use this link to find out more.
https://www.nationaldebtline.org/EW/sampleletters/sole-letters/Pages/Information-about-your-agreement-under-the-Consumer-Credit-Act-%28sole-name%29.aspx
The request can also provide you with a full statement of account, it will be interesting to see what they are trying to claim from you as it appears, or at least it did, that you do not actually owe them anything. It will be interesting to see what the breakdown states.
