Hi Guys
First post so please bear with me.
I took out a loan with Northern Rock in 2003. When the world fell apart I lost my job in 2009 and eventually ended up having to claim benefits. I contacted Northern Rock and asked to put my PPI policy into action. They told me that there was no insurance taken out on the loan and that I'd have to keep paying the full amount each month, £260.
I asked them for a copy of my original agreement and they said they'd send it. To cut a long story short after 10 requests for the original agreement, 5 letters and 12 full payments I told them that I wasn't going to pay them any more until they supplied the original agreement.
I heard nothing from them until nearly 12 months later when a solicitor contacted me and said he was representing NR and had been asked to look at court proceedings. I asked for a copy of the original agreement again and they refused.
I was arranging a dml with pay plan and asked them to request an outstanding balance and a copy of the original agreement. No response again.
Nine months later a CCJ landed on my doorstep from a court 200+ miles away. I'd never received court documents and this was followed by an interim charging order. I was away at an interview in Saudi at the time so opened the two letters within two days of each other. I was given advice which I now know to be wrong in that once an interim is applied for then the CCJ cannot be challenged (From NR solicitor who I contacted as soon as the letters were opened). The debt is now secured against the marital home.
I'm looking to get the CCJ overturned. In your experience is this possible? Sorry if I'm going over old ground but I can't seem to find anything similar on the site.

Well they are in contravention of your CCA request, you could apply to have it set aside on those grounds, that should have been your response at the time, im not an expert but I think if you go back to the court and enter this as evidence, it may be set aside, as NR are defiantly in the wrong here.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
