Dismissal advice

Hi,

I was recently let go from my employer as it was believed that I made some allegations about a co worker that could damage his reputation.

They called me in on the Monday morning and fired me straight away and marched me out the building.

In a letter they gave me when firing me it states that It was false allegations.

Since this has happened it has stopped me from getting a job in the same field of work in the local area.

I have also recently received a letter from the governing body allegations were made about the coaches behaviour but these were not made by me and I have not contacted them regarding any matter.

I am looking to get my name cleared so I can get back in to work.

If there is any advice you could give me that would be great.

    I'm assuming the problem is what is being said in your reference. If so, do you know the actual wording? Hoe long ago was this and how long had you worked there?

    Indeed.

    With less than two year's service the employer did not even have to give you a reason and you have no redress unless there are grounds for claiming unlawful discrimination (e.g race, sex etc).

    As far as the reference is concerned, if given at all, it needs to be true and not deliberately misleading. You can obtain a copy by making a subject access request under the data protection act. If it is provably false then you might have some legal redress although this could be risky and expensive. However, except for a very few occupations, an employer is not obliged to provide a reference at all so if you go down this route then the former employer will almost certainly refuse any further reference requests. Unfortunately most will interoperate this as a bad reference in itself.

    Not an easy situation I'm afraid.

    I would certainly be requesting a copy!

    Another way around this is honesty. You could explain to new employers that you are interveiwing with the situation - show regret etc.
    They might take you on face value and give you a shot?

    I've been sacked from a job and walked into another one by explaining what happened - so it is possible.
